Trayvon Martin: Spike Lee Settles With Family Forced to Flee Home
The Los Angeles Times ^ | Thursday, March 29, 2012 | Michael Muskal

Posted on 03/29/2012 1:33:25 PM PDT by kristinn

Spike Lee has reached an agreement with the Florida couple forced to flee their home after the film director retweeted their home address and they fled to a hotel to avoid problems associated with the shooting of Trayvon Martin, it was announced Thursday.

Elaine and David McClain, in their 70s, left their Sanford, Fla., home after their address was tweeted by a man who thought he had found the home of George Zimmerman, the 28-year-old who shot Martin, 17. Lee then retweeted the McClains’ address to his followers on Twitter.

The McClains have a son, William George Zimmerman, who is not related to the George Zimmerman who shot Martin and whose arrest is being sought by Martin’s family and civil rights supporters.

“The McClains’ claim is fully resolved,” Matt Morgan, their attorney, said in an email. “Mr. Lee personally called them to give a very heartfelt apology. Further, he agreed to compensate them for their loss and the disruption to their lives.

“The McClains were very moved by Mr. Lee's apology,” Morgan said. “They would like the Lee family to be left in peace,” Morgan said.

Earlier, Morgan had said that the McClains wanted to resolve the issues with Lee quickly to illustrate that whites and blacks could work together to settle their differences without escalating racial tensions

The neighbors can have claims as well.

They must pursue them.

Lee should be arrested for endangerment at the least and attempted murder and the most. He would have published the right address if he had had it. If the real Zimmerman had been killed Lee would have been partially to blame - and what about Zimmerman’s freak’n family. That low life animal would have put an innocent family in the line of fire. I know Lee was hoping Zimmerman was white but, oops he’s hispanic - where’s the uproar among los amigos? Nothing? All this is MHO of course.

With Democratic clients, no less. If Obama had a son, he would look like a sleazy lawyer.

You just described Charlie Crist.

Proving they are the bigger people in this case, regardless of the money involved.

It’s a shame that the lynch mob never goes out of style.

Or they could have used the Archie Bunker threat: "I got seven hungry Jewish lawyers that'll tear the flesh from your bones!"

Interesting. Spike Lee, racist extraordinaire, will pay these people for his royal screw-up and illegal act, but he won't pay the $3+ Million in back taxes he owes his buddy, Obama.

Go figure!

Shouldn’t there be criminal charges filed for advocating violence or communicating a threat? Where is the grand jury?

CORRECTION: George Zimmerman WAS arrested! He was taken to the Police Station by force, in HANDCUFFS. He was RELEASED when the police realized they had no basis to hold him!

Obama’s got nothing to do with this one. Morgan’s doing his job representing his client, and apparently did it well. No more, no less.

What sort of settlement was reached? Was money involved? If money was involved, how much are we talking about?

It'll be kept quiet unless one side wants to leak it. Usually they don't. That's standard procedure in torts.

How the heck did this get done so quickly?

Spike screwed up bad and he knows it. His attorney also knows it. McClains and their lawyer talked to Spike's attorney. A claim may not have even been filed because this was cut and dry. Going to court is a pain, and Spike doesn't want this to go to a jury. Most cases settle. Is Spike a multi-millionaire? I have no idea how wealthy that guy is, but could it be an offer they couldn’t refuse was made?

I don't know what was asked, but it probably was close to the amount in damages inflicted if not the full amount because Spike has deep pockets.

Perhaps it’s all legal and legit, whatever the settlement is. But, with lack of details, it makes me think that they were paid a big sum of money. And that this payoff will buy their silence.

That's common practice. Corporations settle all the time. They don't want a trial and the court costs, uncertainty, and lawyer fees that come with it. You never know what a jury will do.

Meaning, among other things, no media interviews by this couple, no discussion of what sorts of threats made them decide to leave their house, or any of that.

True. Most people also aren't fans of the media, don't want to be on camera, and deal with the scrutiny that comes with it. Often mouths staying shut are part of settlement claims. That's usually not a problem for anybody. Both sides want to move on.

He wasn’t arrested. He was detained, questioned, and released. At that time, there was either not enough probable cause to arrest him, or the DA didn’t think there was enough for a conviction. That may or may not change as more information comes out.
