After Day Two: Justices Skeptical of ObamaCare Constitutionality

Day two of oral arguments at the Supreme Court have just finished. MSNBC has just reported the Justices were very skeptical when it came to the constitutionality of ObamaCare. The report also said that although the question of “If the government can mandate the purchase of health insurance, can’t it do anything?” is “extremely complicated,” the Justices were not convinced of the argument given by representation in the courtroom arguing the individual mandate isn’t an overreach of federal government power.

More from Judge Andrew Napolitano on Fox News:

"It appears that Justice Kennedy asked some of the most profound and stinking questions of the government."

"Exceedingly sharp questioning."

"I do believe the court will invalidate the individual mandate by a 5-4 vote," adding Justice Kennedy will vote to strike the mandate.

The Justices always sound skeptical don’t they? Doesn’t mean anything.

Becareful of what you hear. There are many cases in the Supreme Court where they sound like they are going one way but in the end, they go the opposite direction.

The "mandates" are being thrown overboard to establish constitutionality (as defined by the scotus) of the rest of this evil legislation.

maybe I'm wrong. maybe not. These people are wicked, they're not stupid. And when the leftists go on TV squeeling like stuck hogs, you'd better hang the hell on to your wallets.

Whenever liberals start saying anything is “extremely complicated” what they really mean is “our position is indefensible on logical or moral grounds so please stop arguing about it or else I’ll have to beat the crap out of you.”

Did you even listen to the video at the link?! This was CNN! Jeffrey Toobin’s own words. Justice Kennedy is on the right side of the law on this one.

Something for folks to think about!

Oct 28, 1919 > Congress passed the Volstead Act that mandated US citizens could no longer manufacture/use/consume alcohol products. Main result of this was the creation of the Mafia.

Congress made it illegal for a citizen to consume adult beverages.

Dec 5, 1933 > FDR and the Cullen-Richardson act reverses the Volstead Act, doing away with prohibition

2010 - Obamacare is passed by the US Congress mandating that US citizens must buy health insurance coverage or pay a fine.

Congress makes it illegal for a citizen to be uninsured - they must buy a health insurance policy.

In 1919, Congress made it illegal to buy booze.

In 2010, Congress mandates that we must buy a policy.

Interesting contrast in how our government governs...

They try to make the argument that everyone will eventally use healthcare so they can regulate it as interstate commerce. Using that logic, they could require everyone to buy: burial insurance, food, water, toilet paper, clothes, homes, beds, etc. Once they require it, they will mandate which brands or types you must buy. Whatever you are forced to buy will benefit their friends bank accounts.

Yes, I'm sure it was "striking". The CNN reporter (Toobin) live from SCOTUS stated this about Justice Kennedy ... Justice Kennedy … practically his first question out of the box … was … we know that Congress has the power to regulate commerce, but can Congress ‘create’ commerce? [Srsly?! You act like that’s a legitimate question?] The attorney for the government said 'no' but said they weren't creating commerce. FAIL. BIG TIME.

From the attorney representing the states … “if you believe that ‘not acting’ is commerce, there’s no limiting principle to that …………"
