Yes, I'm sure it was "striking". The CNN reporter (Toobin) live from SCOTUS stated this about Justice Kennedy ... Justice Kennedy … practically his first question out of the box … was … we know that Congress has the power to regulate commerce, but can Congress ‘create’ commerce? [Srsly?! You act like that’s a legitimate question?] The attorney for the government said 'no' but said they weren't creating commerce. FAIL. BIG TIME.
