As I understand it,we are already (still) in a state of national emergency. On 9/9/2011 President Obama once again extended President Bush's original 2001 declaration through September 23rd, 2012. If that's correct, the content and timing of his new executive order on National Defense Resources Preparedness is cause for even more urgent concern. Is he already empowered to implement these provisions? Does anyone know whether congress now has any power to restrict his exercise of the state of emergency provisions?
