Newt hints at Rubio for VP

The man of the night at the Jan. 26 University of North Florida Republican debate wasn’t Mitt Romney, Newt Gingrich, Rick Santorum or Ron Paul – in fact, he wasn’t even on stage.

Some might say it was Sen. Marco Rubio.

Rubio was favored by three of the four candidates as a Hispanic pick for their administrations – with frontrunner Gingrich hinting that he might pick Rubio as his vice president.

Absolutely!

I find this subject extremely fascinating and wish for a resolution one way or the other. I don’t believe there is ever going to be a settled thought on this matter until the case has been settled in SCOTUS. I just don’t see it happening.

I wish that both sides would want this settled as well. All I see is obstructing our will to have this heard. It makes me feel that my class of citizen is not worthy of this hearing. Whether I am a citizen or a natural born citizen I seem to have no right to have this heard.

Would you not find that frustrating? I am in fact a natural born, but that is irrelevant. As a citizen I should have the same right!

You are just wrong. There is no legal basis for the birthers unique inerpretation of the Constitution. That’s why no court in America will give you the time of day.

These were natives, or natural-born citizens, as distinguished from aliens or foreigners.” Minor v. Happersett, 88 U.S. 162, 168."

I should have remembered I was on FR before I made that claim.

She’s in 7th grade now. I’ll go get it and report back. It’s there- she was tested on it and I helped her study.

I think I am going to take the word of a constitutional scholar like Mark Levin over your version of what an NBC is. Rubio was born in Miami, he was born an American citizen, he is an NBC and he is eligible to VP or President. Period. No matter how much you cry and whine, nothing is going to change that.

I believe you are correct in everthing you have said.

The problem is, if they do NOT take it up now, we are no longer a nation governed by the rule of law, and have already been destroyed.

Why did they not give equal time to some Chinese-American, Greek-American, Nepalese-American group, etc., to ask their questions?

You are wildly, wildly wrong on this.

English Common law has similarities to what is referred to as US Common law, but in reality, there IS NO US Common law. Our laws were created with the Constitution, which in many areas deliberately rejected English Common Law. You are using a Straw Man argument.

This makes my head hurt. There are so many mixups in that it would be impossible to unwind in a single post. Suffice it to say that English common law was the default rule in the colonies prior to independence, and was/is considered valid within those states except as superceded by statute or subsequent case law. That's only logical, since English common law is what was practiced in all those colonial courts prior to independence, and if you imagine that it vanished overnight with independence, the colonies would have been largely lawless.

You are correct in saying there is no federal common law, as such, because the federal government did not exist during the pre-Constitutional period when English common law was commonly practiced in our colonial (i.e., state) courts.

However, that does not mean that English common law is not considered persuasive in interpreting U.S. Constitutional law, including rights such as habeus corpus, bail, etc. The Supreme Court has routinely looked to how those concepts were understood in England when determining how they should be applied here.

For example, the Constitution says "no excessive bail". But then, how is it that people can be held without bail at all? Well, the Supreme Court found that if you looked at English common law practice, you could see there were occasions where truly vile, dangerous people were held with no bail at all. So despite that clear language of the 8th amendment, people can be held with no bail at all.

That kind of reliance on English common law to interpret what is meant by Constitutional provisions that had a counterpart in the common law is, well, common.

"The citizenship of no man could be previous to the declaration of independence, and, as a natural right, belongs to none but those who have been born of citizens since the 4th of July, 1776."
