On the sex thing. The Constitution protect liberty via the bill of rights. It is not a penal code and gives to the states the power of writing their own a penal code. The federal government only role to play in this is insuring that a state penal code does not violate the bill of rights.
Paul gets into trouble by using the same logic on abortion, he says leave it to the states. but as many have pointed out if you are pro life then abortion is murder and it deprives a person of their right to life which is protected under the constitution. I side with the pro life side of this argument. But all Congress has to do it write a statute they defines an unborn child as a person and then the unborn would be under constitutional protection and the arguments would go away.
Since opponents of Paul know he will not ban behavior at the federal level they falsely claim that he approves of the behavior. It is a lie and a distortion.
