Obama administration calls for halt to Texas execution

WASHINGTON — The Obama administration took the unusual step Friday of asking the Supreme Court to stop Texas from executing a Mexican citizen convicted of raping and killing a 16-year-old girl.

The administration said the court should delay the planned July 7 execution of Humberto Leal for up to six months to give Congress time to consider legislation that would directly affect Leal's case.

The 38-year-old native of Monterrey wasn't told he could contact the Mexican Consulate after his arrest in the murder of Adria Sauceda. His lawyers say police violated an international treaty by not telling Leal he could have consular assistance.

As I recall from a long ago reading, it’s the US that is supposed to contact the foreign consulate that they have nailed one of their citizens for a felony crime on US soil. I believe that’s what the Vienna Convention/Treaty indicates (but it’s the wee hours of the morn here and I’m not going to look it up). That would place the burden for contact with the prisoner onto the foreign consulate. This particular illegal alien rapist and murderer has had attys. for 16-17 years and plenty of time to discuss matters with his consulate. ...Juice him up and ignore Obama!

I also want to correct something I posted on the first page of this thread. Texas won the case regarding the execution of MEDELLIN before the SCOTUS; it wasn’t this case now being discussed. .....Thanks to whomever posted later about the Medellin execution, as it refreshed my memory! (It’s hell gettin’ old)

This execution should go forward double-time, if nothing else, as an affront to the United States Government, never mind the Federal Republic of Montezuma.

Dubya tried this with Texas too.

Both SCOTUS and Texas told him and the UN's ICC to go pound sand and carried out the execution of the 'Mexican National'.

I thought the MF was very clear about what he was going to do and how he was going to govern. Many thought the Obastard was just pandering to the left but there were many that took him seriously.

Fundamentally changing the country meant fundamentally changing the country, that was pretty easy to understand. He was trained by the likes of Alinsky, Wright, and Ayers so I can’t see where the mystery is. He’s a communist and for the country to be run like an old Eastern bloc country seems easily predictable.

I’m all for executing the sob, but what about his not being allowed to call the Mexican embassy? Is this legal?

Death penalty opponents are citing "international law" when claiming the defendant had a right to call the Mexican consulate. International law does not apply in Texas.

Fire ‘im up and make the whole exercise a moot point.

Also, a good opportunity to prove that the States really are co-equal sovereigns with the federal government and not to be lorded around by one sh**ty little executive within their own spheres of sovereignity.

I don't think that's a good idea. Knowing the Mexican justice system, he would have probably bribed a couple of judges and been out walking the streets now. Mexico is incredibly soft on murderers and rapists.

It would be amusing to rewrite our immigration laws to deal with illegals the way Mexico does with their illegals, though. They'd go nuts if we held them to the same standards they use for illegal foriegners in their country.

ONLY insofar as the treaty does NOT VIOLATE OR ABROGATE ANY PART OF THE CONSTITUTION. None of the founding Dads were interested in seeing their handiwork undone by a treaty with some foreign power.
