Dramatic footage shows moment Iraq war vet was shot 70 times in home

A U.S. Marine who was killed when he was gunned down in his home near Tucson, Arizona, never fired on the SWAT team that stormed his house firing 70 times in a hail of bullets, a report has revealed.

The revelation came as dramatic footage of the shooting was released, showing the armed team pounding down the door of Jose Guerena's home and opening fire.

The father-of-two, who had served twice in Iraq, died on May 5 after the SWAT team descended on his home believing it was one of four houses associated with a drug smuggling operation.

I doubt seriously that the widow contacted the attorney. I bet he went to them because this case has screamed lawsuit from the moment that those cops on the scene realized they unloaded their weapons on someone who hadn’t fired a shot. It took a week for that to reach the news media. (I could be wrong about timing. That was a busy week in our household.) But law enforcement circles would have been buzzing with the news the first day. The Pima County Attorney’s office would have known. There are lots of people looking to make political hay over anything. This case would do it.

The timeline below was taken from a different video, but it covers the points if you combine the video and the wife’s statements:

Guy in bed.

0+6 Siren or car alarm goes off for 8 seconds.

0+14 Doesn’t pay much attention, but wife shows up saying she’s scared.

0+20 Rolls out of bed. Grabs rifle and tells the wife to hide.

0+28 Leaves bedroom.

0+30 End of hall, looking at the door.

Between 0+20 & 0+30, the police are saying something...identifying themselves, but hard to understand from the guy standing outdoors & 20 feet away. During this time, the guy is probably in his bedroom & talking with his wife. He’s probably been up for 10 seconds or so. Odds of hearing the cops? Not great.

0+33 Door opens from kicks.

0+40 Cops open fire.

What was the guy doing between 0+33 & 0+40? Well, he’s probably been awake for under 30 seconds. He probably been out of the bedroom for 10 seconds. The safety is on.

At 0+40, the cops open fire. The guy has not shot, but they see a man with a gun and the cops react.

Now for the sake of argument, let’s suppose this happened to me. The wife wakes me and tells me someone is at the door trying to get in. There was a car alarm or siren - don’t know which. I’d grab my 44 and go to look, and would probably get to the door about the time the cops came thru.

I would probably start to raise my gun, realize they were cops, and be lowering it at the same time the bullets start hitting me. Dead over a warrant served by incompetents.

Should it be legal to serve a warrant in a way that practically guarantees the death of the person inside, assuming the person was surprised and predisposed to protect his home and family?

Could a reasonable person, with 30 seconds of thinking, figure out a way of serving the warrant with less danger to all involved?

I don’t care if this ex-Marine was guilty as sin - was this the way a reasonable person serves a warrant?

Does firing 71 shots indicate a well trained unit? When I was in Afghanistan, we were told to use 3 round bursts, not full auto. The Army told us that if you didn’t hit with the first three, continued spraying was just a waste of ammo.

Once the cops were in the door and saw him with a gun, they were bound to shoot - but why did it have to reach that point to begin with? In the same circumstances, the cops would almost certainly find me with a revolver still in my hand and shoot me, and I’m very law abiding - so how can those procedures be right?

That’s a stupid question, but it’s one I’ve already answered. Twice. Lawsuit. O, and a little piece of advice: if you’re ever in a situation where you are the witness to someone dying, or you’re ever questioned by the police about any crime, lawyer up.

See, that’s what’s gone wrong with this country. No matter what the issue is, everyone gets shouted down by the most hysterical, irrational, stupidest loudmouths and no-one can even tell WHAT the truth is, or what a reasonable person is thinking.

At least you’re looking at the facts here.

Most of the people on this thread are spewing out loaded terms illustrating they think all police officers are jack-booted thugs and nazi control officers...a figment of their weak minds. Facts are tough and bogeymen are easy.

The background is that this was one of four raids with warrants on a drug gang. Large amounts of cash, drugs, and a Border Agent hat were found.

They don’t just handout huge warrants on 4 houses for nothing.

I’m not even taking a side on this until more information is known. But some of the ridiculous comments on here are just disgraceful.

Why do you say that dangus? Let me give you a different scenario. The vet hears someone beating on his door, he opens up with full Amour Piercing thorough the door and doesn't wait to identify what's on the other side. You going to defend that man as you defended this rank amateur "swat" team...?

It takes you EIGHT SECONDS to lower your gun? And can I just say that if someone has just firmly knocked on your door the way police pound, you’re pretty damned stupid if you haven’t supposed by then that it’s the police. Believe me, I’ve had police pound on my door. There’s no mistaking a police knock. He should have at least not been at all surprised that they were police.

Sheriffs are elected. Recall ‘em, defeat ‘em at the next election or prosecute them and get ‘em convicted. Those are the three choices; you can’t fire them.

Well, if I were sleeping, I might not make it out of the bed for five of the eight seconds.

I just don’t see someone waking up from a sound sleep, running to grab a hidden weapon that the wife doesn’t know about and pointing it at cops when the guy in question has nothing to hide. I don’t see a rational person doing it even if he did have something to hide such as keeping something at his house that belongs to another family member.

That's a google search that turned up over a million results....Just because someone claims to be a cop and is banging on your door doesn't necessarily mean that it's really a cop.

There were no drugs found at this house. Was the border agent hat the “part of a law enforcement uniform” that was found, or is this more disinformation? If that WAS what was found, all these hysterical ninnies are just proven wrong: he absolutely was a criminal, and IF so, I take back everything I said about this being a tragedy. It’s still tragic that anyone dies, but that WOULD prove that the man brought it on himself.

And to whoever it was that posted about the wife having been a cool customer: Yeah, IF her husband was a criminal, I have no doubts she’d have no trouble coming up with her fairly incongruent claims in a matter of minutes. She was probably trying to extricate herself from this scene before the siren even went off the second time.

That said, I’m not rushing to any judgment that he was a criminal based on a partially errant post on FR. Got anything to back yourself up?

It’s kind of a little tradition on a discussion forum that when you say someone posted something inaccurate that you tell them what you believe to be inaccurate. Otherwise, well, you’re posting baseless comments, which makes you look kinda stupid.
