ORLANDO, Fla. -- An 85-year-old man filed a lawsuit on Thursday against the Orlando Police Department after his neck was broken by an officer on September 18, 2010, a release by the man's attorney stated.
Daniel Daley's attorney claims that he has permanent and life-altering injuries. The release states, "The excessive use of force against him, the negligent and unnecessary takedown procedure applied to him and the utter disregard for his health or life exhibited by his attacker, has led to this lawsuit."
Orlando police released a statement on Thursday saying, "It is not appropriate for the agency to comment on any pending litigation. Any responses will be made in court and under oath."
Daley is a war veteran and had no prior criminal history.

America’s finest at it again.
Cop did one of those takedowns where you grab the bad guy and throw him across your body to the ground. Except in this case the ‘bad guy’ was an 84yo drunk guy and he landed on his neck, breaking it.
The dept has been backing up the cop saying that the old guy was threatening to punch the cop and that the cop used an ‘approved technique’ to throw him to the ground. Except in this case, an 84yo guy’s neck bones broke. A tow truck driver is on record saying the old guy was punching him too a little earlier that night because he was going to tow his car. The tow truck driver was asked how it felt when the old guy was hitting him. The driver replied that it felt like you thought it would feel with a drunk, 84yo guy hitting you. The PD is saying even 84yo drunks can knock out a cop.
Frankly, I think the cop used very poor judgement in this case. He could have just held the old man, cuffed him and through him in a car. Instead, he let the old guy get under his skin and so he tossed him to the ground and severely injured him.
I agree. I doubt if the cop new he was going to break the guys neck.
Regardless this idiot cop will end up costing Orlando taxpayers piles of money.
If I didn't live here and know "The rest of the story" I would tend to agree.
The rest of the story:
The old guy was drunk. The police gave him some order as there was a disturbance going on. The old guy swung at the cop and grabbed his neck.
The cop feels bad about it but the old guy has no one to blame but himself.
Rule 1. If you swing at a cop - you are going DOWN.

They make a big deal about the criminal being 85. I knew a man of 96 (former navy man and merchant sailor) who was suffering from dementia. His family brought him to the hospital for tests and, confused, he took a swing at a big thirtysomething doctor and laid him out cold. Took a couple of orderlies and hospital security to restrain him.

Unfortunately the old guy was drunk, and was the aggressor. This result was apparently just an unfortunate accident from a proper and legal police procedure (old men can be stupid too).
