The Atlanta Journal-Constitution reports:
The Georgia Legislative Black Caucus filed a lawsuit Monday against the state of Georgia seeking to dissolve the city charters of Dunwoody, Sandy Springs, Johns Creek, Milton and Chattahoochee Hills. Further, the lawmakers, joined by civil rights leader the Rev. Joseph Lowery, aim to dash any hopes of a Milton County. The lawsuit, filed in a North Georgia U.S. District Court Monday, claims that the state circumvented the normal legislative process and set aside its own criteria when creating the super-majority white cities within Fulton and DeKalb counties. The result, it argues, is to dilute minority votes in those areas, violating the Voting Rights Act of 1965 and the Fourteenth and Fifteenth Amendments to the Constitution .
Lead attorney Jerome Lee, of Taylor Lee & Associates, said the suit is novel.
The Voting Rights Act forbids a state from doing anything that affects the voting rights of minorities, except with a permissible purpose, he said, citing the redistricting that takes place when the census documents population shifts. In this case, its different because the state actually went outside the normal redistricting process and created these cities that have no meaningful state purpose. According to the 2010 census, Fulton County is 44.5 percent white and 44.1 percent black. About 54 percent of DeKalb County residents are black, and 33.3 percent are white.
Sandy Springs, created in 2005, is 65 percent white and 20 percent black. Milton, formed a year later, is 76.6 percent white and 9 percent black. Johns Creek, also formed that year, is 63.5 percent white and 9.2 percent black. Chattahoochee Hills, formed in 2007, is 68.6 percent white and 28 percent black, while Dunwoody, created in 2008, is 69.8 percent white and 12.6 percent black.

This type of absolute crap lawsuit is a wonderful reason to consider NOT gathering ethnicity data during a census.
These cities broke off from Atlanta because they were paying a heavy burden for downtown/midtown services that they did not receive.
They had no meaningful representation in the Fulton County / Atlanta governments because they were severely outnumbered by other voting blocks. The end result was every time someone needed more money, they increased property taxes, which disproportionately affected the North end.
Gawd. It makes my blood pressure skyrocket. Dude just wants the coffers filled with other people’s money again. I don’t even live in any part of Atlanta affected by these things...
Another thing, y’all should see the beautiful schools popping up every ten feet in these new municipalities. They pop up like mushrooms, with incredible facilities, stadiums, the works.
All that property tax data used to end up going to the people inside the perimeter.
I just want to dissolve them and save tax payers a lot of money. No city government, employees, or "services" means no need for taxes.
The leeches will have to learn to fend for themselves.
Wow, Atlanta just keeps growing. You would have to torture me to fight all that traffic.
Now I would not mind living in some of the small towns maybe fifty miles from Atlanta.
Is there a Georgia Legislative White Caucus?
So only those unincorporated areas that have black majorities can hope to be incorporated into a city? What a bunch of idiots (not to mention racists).
Oh, and the same people whining about blacks losing political clout in Fulton County (because blacks are moving away from Atlanta and into the suburbs to the east, south and west, not because of any racial animus or illegal line-drawing, but don’t confuse them with the facts) then turn around and oppose the creation of a heavily white Milton County (actually, its reorganization—the county existed a century ago before it was absorbed by Fulton County), when excising Milton County from Fulton County would allow Fulton County to have a black majority. May I suppose that DeKalb County Congressman Hank Johnson, the guy who was afraid that the island of Guam would literally tip over and capsize if too many people moved into the north part of the island?
The black commie racists think they have special protection because a black commie racist is infesting the Whitehouse.
Bring it on, mau-maus.
“Will the complaining ever stop?”
Nope, that’s where they get their money and power. They are professional grievance pushers.
My county is subject to Voting Rights Act restrictions.
I call it Reconstruction II.
Atlanta? Yes. . but they won’t.
The 'super-majority black' caucus can go FT!
Make no mistake this is about North Fulton going back to Milton County. The residents of Fulton County pay about 80% of the revenues collected by the county. The folks in South Fulton (College Park, East Point, South Atlanta...) will have to pick up the big bills racked up by the county commission.
