Harris says Obama's action dooms Prop. 8

State Attorney General Kamala Harris told a federal appeals court Tuesday that the Obama administration's repudiation of a federal law denying marital benefits to gay and lesbian couples dims the legal prospects for Proposition 8, California's ban on same-sex marriage.

Harris asked the Ninth U.S. Circuit Court of Appeals in San Francisco to let same-sex weddings resume in California while the court reviews Prop. 8. The case is on hold while the state Supreme Court decides whether the measure's sponsors can appeal a federal judge's decision declaring Prop. 8 unconstitutional.

Even if backers have legal standing, Harris said, "the likelihood that the appeal will succeed on the merits has been substantially diminished" by the Obama administration's declaration last week that the federal Defense of Marriage Act is unconstitutional.

f-n unreal. Going against the will of the voters again and again. The law only apply when they want it to. This White HOuse is unlawful. At what point is it a crime?

With this bunch, it’s only a crime if they SAY it is.

So much for equal protection under the law. The “law” as we’ve traditionally known it, and its handmaiden “justice”, are now subjective (depending on who’s in power).

We are no longer a nation of laws. All I can say is stock up on essentials in case it gets really ugly. Not good.

It isn't Obama's choice to repudiate laws on the books. It is the responsibility of the Executive branch to enforce them. If he doesn't like the law, it is the job of the legislative branch to repeal it or the judicial branch to rule it unconstitutional. Until that happens, the law stands. Harris is engaging in fantasy...just what was expected from this lefty candidate for the AG job. She's all wrapped up in social issues and ignoring criminal issues. Her negligence will come back to bite her.

It's amazing she's only been in there a couple months of her first four year term and we're already seeing how far she'll overreach. She is a nightmare.

It was bad enough when Davis, Arnold and Brown wouldn't defend laws before the courts but Kamala's found an all new low!

This is political strategy and nothing else.

Obama spiking DOMA is an attempt to draw Republicans off message. He knows the GOP House will stand up for law passed by both houses and signed by a president when he will not. He chose DOMA as bait for strategic purposes. You can see their plan revealed in this quote:

“Republican leaders have been claiming to want to focus on the economy, yet their insertion into this case would represent a hypocritical departure from that position,” said Michael Cole-Schwartz, a spokesman for the Human Rights Campaign, a gay-rights advocacy group. Politico

These people are out of control, they have brought anarchy to the highest levels of gov't.
