In ruling against President Obamas health care law, federal Judge Roger Vinson used Mr. Obamas own position from the 2008 campaign against him, arguing that there are other ways to tackle health care short of requiring every American to purchase insurance.
I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that if a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house, Judge Vinson wrote in a footnote toward the end of the 78-page ruling Monday.
Judge Vinson, a federal judge in the northern district of Florida, struck down the entire health care law as unconstitutional on Monday, though he is allowing the Obama administration to continue to implement and enforce it while the government appeals his ruling.
The footnote was attached to the most critical part of Judge Vinsons ruling, in which he said the principal dispute in the case was not whether Congress has the power to tackle health care, but whether it has the power to compel the purchase of insurance.
Judge Vinson used Mr. Obamas campaign words from an interview with CNN to show that there are other options that could fall within the Constitution including then-candidate Obamas plan.

Vinson is best known for his 2011 ruling striking down the unpopular Obamacare bill.

Ok I get that this was “reported” but the judge issued a declaration that the law IS void. Unless that ruling is stayed or vacated, how can the executive branch legally continue to implement this?

I suppose this case will make a stop at the 11th Federal Circuit Court of Appeals; does anybody know the current makeup of the 11th Circuit?

Or puts a stay on the ruling, pending appeal. Which I guarantee will happen.
I believe the judge laughed to himself when he included that little tidbit in his ruling. He realizes that implementation of Ubama's communist health care plan isn't going to happen without money, and the money for implementing Mengelecare must be approved by the GOP-controlled House.
If the GOP-controlled House devotes one thin dime to Mengelecare, they will be out on their asses in 2 years.

Those were the words of an Obama speech that the judge quoted, not the words of the judge.
Or, it’d be like mandating everyone using public transportation to get a car.
Or, telling someone on food stamps to grow a garden and go to the local food bank.

Wow. I just read your most recent post. I guess maybe it wasn’t a rhetorical flourish. Regardless, you are incorrect and insisting that you are correct makes you look not very serious.
Because the individual mandate does not come down on our necks until 2014, thus there is no urgent need to issue a restraining order.
Of course the termites will continue to chew on the wood of the Republic until then even if it is a foregone conclusion. That's just the way 'bamanites are.
I know sometimes I mementarily forget to apply the wisdom too.
