Judge uses Obama’s words against him
The Washington Times ^ | January 31, 2011 | Stephen Dinan

In ruling against President Obama‘s health care law, federal Judge Roger Vinson used Mr. Obama‘s own position from the 2008 campaign against him, arguing that there are other ways to tackle health care short of requiring every American to purchase insurance.

“I note that in 2008, then-Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that ‘if a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge Vinson wrote in a footnote toward the end of the 78-page ruling Monday.

Judge Vinson, a federal judge in the northern district of Florida, struck down the entire health care law as unconstitutional on Monday, though he is allowing the Obama administration to continue to implement and enforce it while the government appeals his ruling.

The footnote was attached to the most critical part of Judge Vinson‘s ruling, in which he said the “principal dispute” in the case was not whether Congress has the power to tackle health care, but whether it has the power to compel the purchase of insurance.

Judge Vinson used Mr. Obama‘s campaign words from an interview with CNN to show that there are other options that could fall within the Constitution — including then-candidate Obama‘s plan.

Great argument. Something to remember when my Liberal friends defend government mandated health care. I can now say that the government can mandate the end to homelessness by mandating people have to buy a house.

95% of all people who make broad, sweeping statements like you have, without any objective evidence whatsoever to support the position, are idiots. The other 5% are just plain dumb.

"100% of Judges are Lawyers."

A Judge is simply a lawyer who couldn't make it in private practice...

Wait until the 2012 presidential campaign. There will be so much material (3+ years worth) to use against the fraud, if he survives the eligibility issue that is.

Pardon the militant language, but Sarah Palin is the only potential candidate who will actually use all of the ammunition she's given.

At the end it will go to the Supreme court, which most likely will declare it unconstitutional

I believe the Washington Times is in error here.

The very last section of the judge's ruling indicates that a federal injunction, which was sought by the plaintiffs, is not necessary, as his ruling that the "Act is unconstitutional" essentially makes Obamacare null and void throughout the land.

As it now stands, the federal government cannot implement Obamacare, unless, and until, some higher court reverses the lower court ruling.

Great advice! My mother practiced this her whole life. I just wish more of it would have rubbed off on me.

Yeah, but did the judge say it thru a teleprompter?

He is 20 years older than Obama and gets along just fine without one. Plus this judge writes his own "speeches" unlike Obama who has them fed to him on his teleprompter
