Can anyone just march into a recruiting office and demand his constitutionally guaranteed civil RIGHT to serve? Or does he first have to qualify? Mentally, educationally, physically, healthwise, morally, etc?

anyone can apply for a “job” with the U.S. military, this does not mean they will be “hired”. they must be able to pass certain physical, mental and emotion criteria. if they cannot pass those standards they will be “fired”. i am told that the military does not keep people who are unfit and unqualified and “make a soldier outta the guy” like they used to. people do wash out in basic training and get sent home. this ruling will not change that. they can dictate that the forces do not remove homosexuals from duty due to sexual orientation, but they cannot make the forces keep or “hire” a person who is physically unfit for duty. there’s your loophole. i believe our military will use that to their advantage.
I don't think so, but if we're talking about the Constitution, I think that the only thing that's even mentioned at all is for Congress to provide for the US Navy.
I don't know if the US Air Force even has a 'right' to exist, and the US Army was just an invention of Alexander Hamilton when President John Adams didn't even like the idea of a permanent standing army.
The Marine Corps pre-dates the United States of America, so Marines get to stay.

Many have made the argument that “Bearing Arms” was seen as primarily the right to serve in the Militia or in the military. I believe that the Second Amendment includes the right to serve in a military force, as well as the right to bear arms in self defense.
Many State Constitutions also include the right to bear arms in defense of self and the State.
A good case can be made that the Second Amendment includes the right to bear arms in a military force. That may simply be the local militia, it does not have to be an elite force such as the Marines.

Service in the military is a privilege, not a right and you must indeed qualify physically, mentally, and otherwise for military service. The military must also have a need for your services. You can be fully qualified and still be told no if your scores are not high enough or you don’t have the right skill set.
That said, the Congress has just removed homosexuality from this list of disqualifiers. A big mistake, IMHO, but I’ve never had large expectations that our politicians would faithfully support our military forces. They have pulled the rug out from under the military more times than I care to remember.
What they have not done (yet), is to change the UCMJ. Sexual behavior can still be punished and homosexuals engaging in their day to day lives within the military will likely run afoul of the military justice system. If they get caught, they should be punished and discharged. That will be the next fight taken up by the homosexual crowd, but its not a fight that need be lost.

I’ve been in the military and there were ‘gay’ people in my unit. If known they were discharged.
It was better for morale and discipline this way.

Jim, That was about the case when I joined the USN many years ago. Now I just hope that I am in the ground before the USSA DDG(G) 69 GaLeTr gets commissioned. Seems to me that the country I spent a large portion of my life defending is going down the tubes due to gutless self serving politician’s, and hordes of slimy lawyers and lobbyists.

do you think people who are homosexual will eventually start prancing around being loud and proud about their orientation? hubbymahem thinks they will not, but he’s been out of the army for years and years. he knew people when he was in who were gay but kept their lifestyle to themselves. do you believe this will cause gays to demand acceptance by everyone no matter what? or cause problems in close quarters? since you are currently serving and i am curious about these issues i hope you won’t mind giving me your honest assessment of the situation. thank you for your service.
