An Army doctor who disobeyed orders to deploy to Afghanistan because he questions Barack Obama's eligibility to be president has pleaded guilty to 1 of 2 charges against him.
At a court-martial proceeding Tuesday in Maryland, Lt. Col. Terrence Lakin of Greeley, Colo., pleaded guilty to not meeting with a superior when ordered to do so and not showing up at Fort Campbell in Kentucky where he was supposed to report.

Yes, if Lakin had indisputable proof that Obama was ineligible, it would still be irrelevant to his court martial proceeding. His superior commissioned officers’ orders were legal under Title 10.
If Obama ordered Mike to round you up and send you to a camp, would Mike do it? It would be a lawful order, now that we’ve accepted the precedent of “Constitution be damned”.
Or would he end up exactly like Lt Col Lakin?

But even at that he had to commit forgery and perjury to see it done, and he had to get the HDOH to hide their Administrative Rules and break the Federal General False Statement Act. And Nancy Pelosi had to perjure herself by claiming Obama was Constitutionally eligible and/or “the duly chosen candidate of the DNC.”
I do want the loopholes closed so we never have this happen again. But even as things are right now, it was only able to happen because of crimes committed. Unless and until the people who committed those crimes are served justice, Soros wins and America loses.

What I can say is that he would never answer my questions. Preferred the Alinsky route. Until I encountered him I actually thought that the military would do the right thing. I’ve now seen another side of the military, and it’s a reality I have a hard time dealing with - mostly because the military people I have known have all been the honorable kind.
Nidal Hasan made it blatantly obvious that the military is being targeted by our enemies. The Islamists and communists have ALWAYS said they would destroy us from within, by getting the camel’s nose under the tent and then blowing the whole thing up in our faces.
I hate it that the camel’s nose is in the White House.

I’m thinking of asking at the nearest recruiting office if there’s any way I could serve a week of Lakin’s sentence, since he is the one person who has been willing to stand in for me. God knows my elected officials haven’t - not my Rep or Senators, not my governor, AG, or SOS. Nor any of the political appointees such as the US attorney, nor any supposed “law enforcement” such as the FBI.
The one person in this nation who has stood in for me, with standing to demand answers, is Lt Col Lakin.
I would gladly serve a week of his sentence. And if they wouldn’t let me serve it FOR him, I’ll ask if they’ll at least let me serve it WITH him.
My only question is who would be the right people to ask.
My own reading is that there is no requirement in the Constitution for the the taking of the oath or affirmation to be in public. If there are witnesses to the oath or affirmation then it stands.
There have in fact been private unrecorded swearing ins on the death of a sitting president so it’s not completly unprecedented.
Yes the President would be able to issue orders to deploy. “Who would decide that and how?” is probably the wrong question - it’s really “How could someone challenge that?”
I don’t have strong views on the answer but impeachment and conviction in Congress is the most obvious. I doubt that the use of Quo Warrento is constitutional (but I could be wrong).

The Congressional Research Service sent out two different memos telling Congress-critters that it is/was not their place to deal with the eligibility question. The CRS says it was the job of the states to do that.
Sort of blows away Lind’s claim that the issue is a political question, if Congress isn’t even able to deal with it.
Sort of blows away the idea that the certification of the electoral vote says anything about Congress certifying eligibility.
And this is the CRS who is saying this, mind you. Not me. The legal experts advising Congress.
