Driver who killed 5 in Calif crash freed from jail

SAN DIEGO — A suspected drunken driver who killed five people when his car slammed into a group of motorcyclists has been released from custody in Southern California.

The California Highway Patrol says Carlos Bobadilla of Mexicali, Mexico, was freed Sunday but could still face drunken driving charges when blood tests come back.

The driver that hit the bikes is not at fault... it was another driver that caused the accident and even the group of bikers stated that Carlos Bobadilla was not at fault.

They’re still looking for the driver that caused the accident.

CHP said he reeked of alcohol and was arrested on suspension of DUI.

See if you can be honest here.

Question:

If the Mexican was drunk and or impaired by alcohol, could this have been a cause of him losing control of his vehicle, crossing the center line and killing the American bikers?

Reported by other cyclists involved. It’s not a cut and dry case. A “gold Honda” was the cause of this whole horrible mess.

Yes! Of course! But he wasn’t the cause of the accident! The “Gold Honda” forced his reaction. He swerved the wrong way to avoid a head-on collision with another car. Read the reports. If the “gold Honda” hadn’t blasted into his lane, this accident would not have occurred. I don’t condone his actions, but it’s not as simple as what you wanna believe.

Doesn't matter. He was DRUNK while driving.

Lemme make it simple for ya Dr.

If he was NOT under the influence, he might have been able to control his vehicle, avoiding losing control and veering back left, into the bikers.

This is not complicated.

The Honda only forced the Mexican driver to the right shoulder, once there, the Mexican driver lost control, veer back left, crossing the center line into the bikers, killing them.

No contradiction at all. I did not exonerate him. But,,, you’re driving down a two lane road, and suddenly, a “Gold Honda” swerves into your lane. A head on collision is in the works. What do you do? I suggest you check yesterdays posts about this accident. Yeah,,,, the guy might be an illegal. He might have been a visitor. We don’t know. But what we do know is that his reaction was to a car that was gonna hit him head on if he didn’t swerve,

If the Mexican was not drunk but was forced off the road b y an oncoming car, could that in itself contributed to the accuident? BTW the CHP did not say he reeked of alcohol, they stated they did smell alcohol, that doesn’t mean he was drunk nor does it mean he caused the accident. I told you last night your fixin to bust a vessel if you don’t learn to relax.

I think the point is that of course, if he was drunk it may have contributed to his reaction, but that doesn’t make it the ~cause~ of the crash. It’s also possible that a sober driver could have done just the same thing. That’s a fact that has to be sorted out by a jury.

Of course if he was DUI, he should be punished for that, apart from whatever fallout there is from the crash.

Say some drunk driver is sitting at a red light and gets rear-ended at high speed— knocking his car into a pedestrian in the crosswalk. Does the DUI make it his fault there too? No...

Actaly he didn’t swerve the wrong way. He swerved onto the shoulder, lost control and swerved into the other lane by overcorrecting.
