Yet more proof Pelosi never read the health care bill

Yesterday, in President Obama’s press conference he mentioned the possibility of eliminating the health care bill’s onerous 1099 provision — which requires small businesses to submit a 1099 form to the IRS every time they make an expenditure of $600 or more — as point of potential comprise with the GOP on health care reform. (Of course, it wasn’t that long ago Democrats were protecting the provision from GOP attempts to repeal it, but funny how post-election the President seems a bit more flexible on the matter.)

In any event, soon-to-be-former Speaker of the House Nancy Pelosi just gave an interview to Diane Sawyer at ABC News where they discussed health care reform:

So, I– I don’t– I don’t– think they’re going to take health care apart. There are certain parts of it that we all may want to review– one way or another. Put it up there. But the fundamentals of it, you know, when we have our patients’ bill of rights about no preexisting conditions, and those provisions, they are– they cannot be there unless you have this basic structure of health care reform.

So, when we have this debate piece by piece, I think the American people will see how they like pieces of it, and how they relate to each other. And that some of that– you know, a 1099, it was a Senate provision. We didn’t like it in the House. The President mentioned it today. We’ve already passed on the floor– the repeal of 1099 in the House of Representatives. So, you know, there are certain pieces of it that should always be subjected to review.

Um, okay. First, Pelosi’s flat out wrong about one thing. The 1099 provision was included in the language of the House bill, perhaps Pelosi will get around to reading it one of these days. As for whether the House has passed a repeal of the 1099 provision, I don’t know what she’s talking about either. Republicans attached a motion to recommit the 1099 provision to H.R. 5893 over the summer. Rather than allow the 1099 provision to be repealed, Democrats pulled the bill. It was brought up again shortly afterward and it failed to garner the two-thirds needed for passage because Democrats used tax increases elsewhere to make up for the money that would be lost.

Pelosi can spin all she wants, but the President’s concession on the 1099 provision should be seen for what it is — a total about face on the issue.

There is also a 3.8% Tax appllied to all real estate sales. Yes. Its in there. No one knows about it yet. Sell a 500K house= $19,000.

Obama and Pelosi would love to see the Reps just tinker with bill, improving parts of it like the 1099. It needs to be repealed, not improved.

If they make any changes to it, it should always include Nancy Pelosi as the sole exception to it. She needs to fill out a 1099 when buying a cup of coffee!

Republicans should probably leave the 1099 provision in there, just so all of Obamacare collapses from non-compliance.

Sorry, but in this case her idiocy actually has a bit of justification.

The only way Obamacare was passed after Scott Brown won in Massachusetts was to take the Senate bill with no changes and approve it as the House bill. That way, they could pass it in the Senate with no further debate (and therefore no filibuster).

So, Pelosi is right that the 1099 provision came from the Senate version of the bill, not the House version.

Of course, that's not really an excuse because she accepted the Senate version and rammed it through rather than do her duty as a Representative and consider legislation directly. She's still responsible for it.

Similarly, the reason the Republican attempts the amend the bill were all voted down - including the 1099 change, and the change to preclude sex offenders from getting Viagra under Obamacare - was because if there were any changes to the Senate bill at all, it would need to be considered for further debate and hence would be filibustered.

Now that it's passed, and they don't have to pretend that it's wonderful and a great accomplishment "for the people", they can consider all sorts of changes. Pelosi would probably be willing to resurrect the originally passed House version, which was in many cases less evil than the Senate version.

However, when she forced the Senate version through the House, she became the owner of *that* version, not the earlier House version.

I met Eric Cantor at a rally for Adam Kinzinger in the 11th district in Illinois 2 weekends ago and asked him to please repeal this and he said that this was the first thing on the agenda if they won a majority in the house. I guess he was serious. This will bury me in paperwork for my manufacturing business. YES!!! Less stress for me and it's a start. Now let's hope they work on total repeal of that fraud of a health care bill!

Whether she read it or not (and I don't think she did) everyone needs to know that congressmen do not write the bills. Their staff and lobbyists write the bills. These so-called experts and technical writers are the power behind the elected officials.

People need to know that the newly elected congressmen/women will have staff that is sent from the "leadership" to work in their offices. They will work their ways and influence the outcome of legislation.

It's a little more complicated than that and not as onerous. But it does get the camels nose under the tent.Note it's on profits not on the gross sales price.

The 3.8% real estate sales tax only applies to single tax payers making more than $200,000 or joint taxer payers making more than $250,000 AND you wouldn't pay on the first $250,00 in profits for a single tax payer or $500,000 in profits for a joint tax payer.

The following is my understanding of the “3.8% Medicare Tax,” which goes into effect in 2013, and the revenues from which will go into the Medicare Trust Fund:

Tax on real estate transactions depends on your income and whether or not you are single or married and filing jointly. The tax doesn’t apply to the first $250K of UNEARNED income (which may or may not be from the sale of property) for individual taxpayers and $500K for married couples filing jointly. Since, most taxpayers make less than $200K per year and most home sales don’t clear profits exceeding $200K, the vast majority of Americans will not be subject to the tax.
