WASHINGTON, July 30 /Christian Newswire/ -- Larry Klayman, the founder of corruption watchdog Judicial Watch and now Freedom Watch public interest law groups, has filed a complaint before the U.S. Supreme Court at the behest of pro-life organization Declaration Alliance, asking that the high court disbar Elena Kagan.
Kagan, while she was an Associate White House Counsel in the Clinton administration, falsified an expert medical report, prepared by the American College of Obstetricians and Gynecologists (ACOG). In this report, ACOG had originally found that partial birth abortion was in fact not medically necessary to save the life of a woman, but Kagan changed the report’s finding to say that it was an appropriate procedure under some circumstances. This altered report was then relied upon by the U.S. Supreme Court in striking down legislation banning partial birth abortion.
In filing the complaint, Klayman issued the following statement:
"The rules of legal ethics require her disbarment and I intend to pursue it, to set an example that prospective and sitting judges, or anyone in the legal profession or otherwise, are not above the law."
Klayman represents the Declaration Alliance, a national non-partisan social welfare organization founded in 1996 by Ambassador Alan Keyes. Excellent! I suggested this a couple of weeks ago. It was a serious ethics violation.
I don’t know if he’s an idiot, but he seems to have been serially ineffective as a plaintiff.
He has been around a long time and as far as I know, he never accomplished anything.
I say more power to him. No one else is trying to do much to put the skids to this appointment.

He files lawsuits for the publicity but then always loses, thereby helping to establish precedent in support of the position he claims to oppose.
A bit harsh -- professional gadfly might be more appropriate.

Does anyone take him seriously? On its face, this lawsuit doesn’t seem without merit.
That’s just the problem, the complaint does seem to have merit. But by filing complaints which he then abandons, he makes it that much harder for someone else.
I don’t particularly see what’s so wrong with Kagan.
Isn’t there anything else the administration’s doing to worry about?
She’s not awful and no more liberal than JP Stevens.
So, in effect, since he is already marginalized so is whatever argument tries to make. That’s a shame (especially this time) :(
