Court rules for gun rights, strikes Chicago handgun ban In another dramatic victory for firearm owners, the Supreme Court has ruled unconstitutional Chicago, Illinois' 28-year-old strict ban on handgun ownership, a potentially far-reaching case over the ability of state and local governments to enforce limits on weapons.
A conservative majority of justices on Monday reiterated its two-year-old conclusion the Constitution gives individuals equal or greater power than states on the issue of possession of certain firearms for self-protection.
The court, however, said local jurisdictions still retain the flexibility to preserve some "reasonable" gun control measures currently in place nationwide.

Which is exactly why there is a 2nd Amendment.... The Founders/Framers didn’t trust any part of the “Government” either! Even the one they were in the process of creating. Only a fool would trust his Life, Liberty, or Happiness to the Kids in Washington......
One more SC appointment and this will be reversed.

An absolute, clear victory on incorporation.
Self-defense is a basic right, recognized by many legal systems from ancient times to the present, and the Heller Court held that individual self-defense is the central component of the SecondAmendment right.
Sweeeet! No more "hunting or sporting use" BS.
Court found that this right applies to handguns because they are the most preferred firearm in the nation to keep and use for protection of ones home and family,
So no more treating handguns as if they were some specially deadly weapon, not covered under the 2A.

One of the big claims of the gun grabbers is that RTKBA is not a "fundamental" right. This reaffirms that it is.

This is important. The "interest balancing" criteria weakens whatever it's being applied to, where they can eliminate a right because they think it balances towards the interest of the state, security, safety, etc., in a specific case. That it is a fundamental right not subject to interest balancing means lawmakers and inferior judges have to be very careful about infringing it.
After that, the majority did a sound trashing of the dissents, with Scalia destroying Stevens' arguments. Thomas did a great concurrence, differing only in saying that the 2A is a privilege of citizenship and should be incorporated through the privileges and immunities clause instead of due process. I think I agree.
This is the statement that will come back to bite us in the a**. It will take years of going back to court on every little obnoxious gun law in order to finally get SHALL issue in every state and to affirm that we have the right to open carry. I wonder how this will affect CAs stupid law on open carrying of empty firearms.
