Not sure if he actually said this, but if he did, then he obviously spoke without first reading the legislation. The AZ Immigration Law states that LEO must have reasonable suspicion that the person is here illegally before the LEO can detain the person, and it specifically states that the reasonable suspicion cannot be based solely upon the person's race or ethnicity.

This is the exact same standard that LEO must follow whenever they decide to detain a person for any crime (i.e., LEO can't detain a person for robbing a bank unless he has a reasonable suspicion that the person, in fact, robbed a bank, and the suspicion can't be based solely on the suspect's race or ethnicity).

The law states that any LEO who comes into "contact" with any person whom he may think is in violation of federal immigration laws (iow...an illegal alien) will take appropriate and reasonable steps to determine that person's status.

The key here is coming into contact. That is as far as the guidelines go and could include visual.

You mean, a law goes too far if one of those places in the US wants to defend itself — where people are being shot on their on land and/or hacked to pieces by arms-carrying coyotes/smugglers? Or where illegals get free stuff and rachet up mortgages and then walk away scott free? You mean, one of those places where people have to defend themselves instead of preaching ‘peace at any cost’” How difficult it must be to deny others their rights to self-defense when they themselves pay others to perform any needed ‘violence’ or defense suggested against Their Highnesses?

This idiot hasn’t even read the bill. It merely enforces the current federal laws. You get caught by speeding, wreckless driving and can’t show ID etc and there’s attrition through employment. You can’t hire illegals! They’ll leave automatically

Did you read the law? It does not state anywhere that an individual must first be caught speeding or wreckless driving (actually a good thing) in ordr to be stopped. There are no guidelines or parameters other than...if a LEO comes in "contact" with an individual and suspects that individual of being here in violation of the law.

Coming into contact leaves too much room for error.

Cops routinely stop people on the street, in malls, in cars just for looking suspicious, yet, when it comes to illegal aliens we are supposed to not apply the same standards of law enforcement?

When Arizona police stop a suspect for probable cause—speeding, shoplifting, whatever—they can ascertain if the suspect is a citizen, green card visa holder, or an illegal. This law impacts the law-breaking illegal alien much more than the low profile illegal.

That is not what the law says. The only qualifiers for stopping and verifying status are contained in the first section...

“For any lawful contact made by a law enforcement official… where reasonable suspicion exists that the person is an alien…”

There is nothing that says that an underlying violation or crime must have been observed, only that "lawful contact" be made (what does that mean?) and that "reasonable suspicion" exist.

So it will be up to the cops to determine what constitutes reasonable suspicion/probable cause.

I’ll be really surprised if this isn’t overruled in Federal Court.

It is the "lawful contact" phrase that is troubling. There is no legal definition for lawful contact. It could mean that the LEO has nothing more than visual contact...I saw the guy, he looked illegal...

The rest of the law is absolutely fine. This though will kill it.

What about all the training the LEOs are required to undergo now to ‘teach them’ what to look for, and how to handle it, without involving ‘racial profiling’?
