Who said it never went on? It went on then like it does in prison now. Are you telling me we should encourage such behavior by calling it a God-given right and forcing local communities and even individuals to accept it as "normal"?

The Founding Fathers knew quite well that men do not have a God-given right to vice. Does the constitution say what rights belong to the government to be granted to the citizen?
