New Hampshire proposes state sovereignty law--with a twist
St Louis Gun Rights Examiner ^ | 1 January, 2010 | Kurt Hoffman

Posted on 01/02/2010 7:02:00 PM PST by marktwain

We've talked many times before (a few links are below the flag picture at the right) about the growing movement on the part of states to assert their sovereign powers as protected by the Tenth Amendment. In the context of discussions here, this comes down to states proposing (and in the cases of Montana and Tennessee, already passing) laws that would exempt firearms, ammunition, and firearms accessories manufactured in-state, and kept in-state, from federal regulation. This, as one might expect, doesn't sit well with the feds, and is being challenged. The BATFE, in the meantime, has already announced its intention of ignoring such laws.

That is not stopping more states from hopping on the state sovereignty bandwagon, with the lastest to do so being New Hampshire.

Pre-filed for the 2010 legislative session in New Hampshire, House Bill 1285 (HB1285) seeks to “exempt firearms, firearm accessories, and ammunition manufactured in New Hampshire from federal law and regulation.”

Don't call the Live Free or Die state a copycat, though--the New Hampshire bill contains a very interesting provision not (to my knowledge) seen in any of the other states' legislation.

"Any official, agent, or employee of the government of the United States, or employee of a corporation providing services to the government of the United States that enforces or attempts to enforce a act, order, law, statute, rule or regulation of the government of the United States upon a personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in New Hampshire and that remains within the State of New Hampshire shall be guilty of a class B felony. (emphasis added)"

Hmm--I'm guessing that's not going to sit well with the BATFE, or the entire federal government, for that matter.

Goes montana one better. I like.

“Any official, agent, or employee of the government of the United States, or employee of a corporation providing services to the government of the United States that enforces or attempts to enforce a act, order, law, statute, rule or regulation of the government of the United States upon a personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in New Hampshire and that remains within the State of New Hampshire shall be guilty of a class B felony. “

As STUPID as government agencies are... NH may need to consider building MORE PRISON SPACE!

The longer the leftists hold power in Wasington, the mmore states will indeed pass 10th amendment legislation. When we have 2/3rds of the states, the feds will have to fight the convening of a constitutional convention.

The NH felony provision will be enforced by some very burly NH State police officers. And its interesting to note that Sturm Ruger, among others, has major manufacturing facilities in NH.

I’m sorry - I really can’t find a dang thing in the Constitution about the BATF, with or without that final “E”.

I find a great deal, however, about limits on a hubristic central government.

What’re these brave men and women gonna do with theyselves when they’s no longer welcome in these here fifty states?

The video you posted was hearting! Funny thing is the view counter for the video is stuck on 331. Someone commented about it in the comments being stuck at that number and that is the number it still shows as I viewed it. Is that their way of trying to take the wind out of our sails?

Put that “twist’ together with this - and the Feds are impotent.

Listen to this - every word. Sheriff Mack took the feds all the way to the Supreme Court after being ordered to enact the Brady Bill in his state.

He WON! And now is spreading the word to sheriffs across the country.

Get his brochure and hand it, face to face, to your sheriff.

Don’t count on Delaware. According to my state rep, it’s too conservative. Figures why Delaware is the ONLY state that has never NEVER filed a 10th Amendment resolution. Also, Delaware is the ONLY state that doesn’t recognize that all power comes from the people, in its Constitution.

And people wonder why Delaware sends such low quality people to Versailles on the Potomac?

YES

YES

YES

YES

YES

Its about fu*king time (please excuse the language I'm excited at this news)

The sheeple are at last reviving from their comatose like slumber.

This must not stop. This must continue.

Think of it truly conservative states will attract more constitutional conservatives to live within their borders. Constitutional taxes only, a total adherence to the constitutional for the United States.

On the flip side. Liberals love to give out other peoples money to welfare deadbeats? No problem, liberal states like New York, New Jersey, Connecticut, Massatwoshits, Californacator, and a host of others of like mind will attract a sh*t load of welfare deadbeats, crack heads, illegals, sodomites, pedophiles, misunderstood gang-bangers, total socialistic pigs, communist dirt-bags, those wonderful peace loving people of the muslim faith and a host others of like mind.

They'll be able to tax the snot outta each other all day long as they blissfully dance naked in the streets singing "we are the world...". It'd be total paradise for the liberals for around a year or until their completely broke.
Absolutely no Federal money will be used to "bail out" their unrealistic Shangri-La.

They have a better idea how to run things, then say by by and leave the rest of us alone.
