There is obviously a lot of discussion on FR concerning Obama's decision to try Khalid Sheikh Mohammed in a civialian trial in NYC. Most of the comments have centered around the horrible possibility of a new terrorist attack against the court or somewhere nearby.
I want to focus on another item I haven't seen discussed... what would happen to KSM, etc if the verdict is Not Guilty? Do they walk? Are they deported? As cleared, are they free to roam the streets of NYC? I am being deadly serious... If you open this to the civilian legal system, what would literally happen if they are not actually convicted?
If anyone's reaction (on the left OR right) is to scoff or laugh and think, "well of COURSE they will be found guilty", then I ask... what is the point of a civilian trial, if a guilty verdict is 100% guaranteed? If it is NOT guaranteed, even by the slimmest margins, then what in God's name will happen if a not guilty verdict is handed out? This needs to be hammered relentlessly to the Obama administration. I want an answer to this NOW and I will not accept the answer of "justice will be served." I want to know what the hell we are going to do with these terrorists if they are cleared. Just... nothing?
And, by the way, how long before the media starts referring to the them as "alleged terrorists" now that everything is sucked into the civilian legal system?

Oh, and by the way, if it wasn’t already frighteningly obvious, you can officially call the end to the War on Terror. Obama has pulled the plug on it; back to the fantastic “law enforcement” angle that proved SO SUCCESSFUL in NYC from 1993-2001.

How can you be so naive?
All that has to happen is for the judge to rule that the confessions were made under duress by a means not legal, etc., and they walk out the door.
If you think this is not possible, I would suggest that you go back over the thousands of words written by the liberals, including McCain’s , on the subject.

0bama then goes on to blame the Bush administration for using college fraternity hazing tactics that were "clearly unconstitutional." "Had Bush 'stuck to the Constitution, these terrorists would have gotten the death penalty they richly deserve." Bank on it.
I'm convinced that 0bama cares nothing about the people of New York who will be adversely impacted by this trial and eventual acquittal.

This probably won’t go to trial until well after the ‘10 election.
I have a few questions also.
Being a federal trial, does the jury have to be unanimous?
A couple “moderate muslims” on the jury may be all they need.
Or, will they go fo a non-jury trial?
What are the charges?
What a bout a speedy trial, Miranda warning, etc?
Once on American soil they are given the full protection and rights of an American citizen. Therefore, if they are indeed found not guilty they are free to walk any street that interests them. Perhaps they will start a bomb making business in Chicago with Billy Ayers.
These terrorists won’t be deported. Most other countries, recognizing the danger of having terrorists walk free on their streets, do not want to accept any of these scum... which is of course why they’ve been hanging out at Club Gitmo all these years.
A hung Jury is more likely.
This is just one of the reasons this is a potentially devasting move for Obama.
Should KSM be acquitted there would be outrage not only in NYC, but throughout the country.
For this reason and several others, I maintain there is no upside for Obama.
