(1) the manufacture, distribution, and importation of firearms is inherently commercial in nature;

(2) firearms regularly move in interstate commerce;

(3) to the extent that firearms trafficking is intrastate in nature, it arises out of and is substantially connected with a commercial transaction, which, when viewed in the aggregate, substantially affects interstate commerce;

(4) because the intrastate and interstate trafficking of firearms are so commingled, full regulation of interstate commerce requires the incidental regulation of intrastate commerce;

(5) gun violence in the United States is associated with the majority of homicides, over half the suicides, and two-thirds of non-fatal violent injuries; and

(6) on the afternoon of May 10, 2007, Blair Holt, a junior at Julian High School in Chicago, was killed on a public bus riding home from school when he used his body to shield a girl who was in the line of fire after a young man boarded the bus and started shooting.

(b) Sense of the Congress- It is the sense of the Congress that--

(1) firearms trafficking is prevalent and widespread in and among the States, and it is usually impossible to distinguish between intrastate trafficking and interstate trafficking; and

(2) it is in the national interest and within the role of the Federal Government to ensure that the regulation of firearms is uniform among the States, that law enforcement can quickly and effectively trace firearms used in crime, and that firearms owners know how to use and safely store their firearms.

(c) Purposes- The purposes of this Act and the amendments made by this Act are--

(1) to protect the public against the unreasonable risk of injury and death associated with the unrecorded sale or transfer of qualifying firearms to criminals and youth;

I got a call from the NRA on this one today so I googled it.

Dumbest parts:

No one under 18 may posses a fire arm which means I can’t send my 16 year old son off to shoot some squirrels.

A ban on “any semiautomatic firearm that can accept any detachable ammunition feeding device” which disqualifies my $250 .22 Ruger rifle I use for plinking.

For those who don’t own one, .22 semi automatics are the best to give kids for practice as they are cheap to buy, cheap to own, light to carry and don’t have to be reloaded after every little shot.

This is a challenge: Pass such a law. People from all over the country from all walks of life — who own no gun and don’t plan to — will rise up and demand the federal government go back in its little, restricted box.

Congress has used this dodge before, but it has always struck me as a violation of both the letter and the spirit of the Constitution.

Intrastate commerce is not interstate commerce, no matter how much one may be alleged to "affect" or be "commingled" with the other. It is hard to imagine that the Framers intended the commerce clause to justify any and all regulation of private enterprise by the national government.

Wizened, shriveled up, graybearded, nearly inarticulate, his days as Black Panther Bad Dude are decades gone (I’m near his age, BTW).

Agree, this is old news and whoever on his staff concocted the language in HR 45, knows it doesn’t stand a prayer.

Dems are evil but not stupid, and they either know or perceive that the people are arming to the teeth.

The national socialists want to enact a law as draconian as the 1928 "Law on Firearms and Ammunition." After which they will, like Hitler, use community organizers to gin up violence and pass a law like the Nazi Weapons Law (Waffengesetz) passed in 1938.

Which would obviously include all the Evil Black Rifles and SKS-pattern rifles, but as well all the M-1 Garands out there.

In Lopez, the Court firmly struck down the ‘gun free school zone’ concept on several points, one of which was that the interstate commerce interest was so flimsy.

From the ultimate authority (not), wikipedia:

“The Court essentially concluded that in no way was the carrying of handguns a commercial activity or even related to any sort of economic enterprise, even under the most extravagant definitions.[14]

The opinion rejected the government's argument that because crime negatively impacted education Congress might have reasonably concluded that crime in schools substantially affects commerce.”
