Bias Case Looms Large for Nominee [Sotomayor & Firefighters]

It is the 134-word summary order in Ricci v. DeStefano, which upheld the decision of New Haven, Conn., to throw out the promotion test it had given city firefighters when no African Americans and two Hispanics qualified for advancement.

The case is under review by the Supreme Court that Sotomayor would join. If the decision is reversed -- which, from the tone of oral arguments in April, seems a distinct possibility -- the high court's ruling will probably come at the end of June, just as the Senate and the nation begin to consider Sotomayor's qualifications.

The White House, concerned that a reversal would be seen as an embarrassment for its nomination, is rolling out a multi-pronged strategy to explain the case and Sotomayor's role in it. The first step was to offer a collection of legal experts who say the ruling marks Sotomayor not as a judicial activist, or even a supporter of minority rights, but as a conservative jurist whose actions show how closely she hews to court precedent.

Federal guidelines presume discrimination when a test has such a disparate impact on minorities.

That's the crux of the problem. It presumes that all races and creeds have identical talents and work habits and that the only explanation for results such as in this firefighter's exam is discrimination.

Thomas Sowell, a terrific economist and a gifted author (who, incidentally, happens to be African-American) expounds on this topic in many of his books and columns, indicating that there is no evidence to support the theory that people who come from different cultures, with different genetic makeups, should be exactly equal in their talents and ambitions. Why is nearly every professional hockey player white, while nearly every basketball player is black? (Hint--it's not due to discrimination.)

These things are so rediculous. If the minority doesn’t score the highest, the test is faulty.

If the minority scores the highest, the test is okay.

How does a “non-minority” advance?

What motivation does and minority have to seriously study and work hard at mastering the tasks that are openly publicized? Are we at the point where we say all of certain type jobs belong to minorities?

It’s not like the test is about how to be a white person or a culture test.

The guy who scored the highest studied his butt off and is a TRUE minority with a TRUE challenge - dislexia. Now, if a person can work past that hurdle, a minority should be ashamed to pull the race card.

We have a historic black president. It is time to be done with racial politics. As Obama says, “let’s move forward” - and unlike Obama, really mean it.

No, you missed the point of this case.

Out of 118 applicants, 17 white and 2 Hispanic (presumably not counted among the 17 white) firefighters got high scores on the promotion eligibility exam, but no black firefighters got high enough scores.

But, the city threw out the test results as discriminatory, since no black applicants would have been eligible for promotion. Some of the white firefighters and one Hispanic firefighter sued. La Raza was not involved, and Sotomayor didn't help Hispanics. But, she demonstrated her strong support for discriminatory policies based purely on race.
