S787 Clean Water Restoration Act changes (I HATE THAT WORD NOW) SEC. 4. DEFINITION OF WATERS OF THE UNITED STATES. ... (3) by adding at the end the following:

`(25) WATERS OF THE UNITED STATES- The term `waters of the United States' means all waters subject to the ebb and flow of the tide, the territorial seas, and all interstate and intrastate waters and their tributaries, including lakes, rivers, streams (including intermittent streams), mudflats, sandflats, wetlands, sloughs, prairie potholes, wet meadows, playa lakes, natural ponds, and all impoundments of the foregoing, to the fullest extent that these waters, or activities affecting these waters, are subject to the legislative power of Congress under the Constitution.'. SEC. 5. CONFORMING AMENDMENTS. (1) by striking `navigable waters of the United States' each place it appears and inserting `waters of the United States';

(9) `ground waters’ are treated separately from `waters of the United States’ for purposes of the Federal Water Pollution Control Act and are not considered `waters of the United States’ under this Act;

So the federal government is going to take over and replace the 200 years of water law — and rights to water — that have been worked out between and among the states? The states aren’t going to be very happy, nor are the Tribal entities that have water and water rights. The federal government just got through spending $500 million on one water project to satisfy tribal claims in the Four Corners area of Colorado. This is an armed robbery. And the federal government will soon be telling you that you cannot mow your grass.

Not only a “blank check”, it can be filled out again and again, for whatever amounts the Feds deem to be fair (to them).

I see a HUGE states’ rights issue here. But since this bill was sponsored by Feingold, the chances of it being declared unConstitutional are somewhere between slim and none, and slim just left town.

Is anybody sure that several Western states won’t take umbrage at this erosion of their authority? Water rights are at the CORE of a lot of law in the arid West.

Key point here is that INTRASTATE commerce is now controlled by Feds.

Hello lawyers, do you hear that? Who’s got the cojones to take this all the way to SCOTUS?

This will allow Obama to tax us more and for his Communist government to control the very essence of our lives by controlling water we use.

This is part of the “mopping up” operations the Dems have commenced in vast scale following the election of 2008.

Govt. intends to bureaucratize who and what gets water, probably down to the milliliters per day.

Water Rights here in Nevada go back to 1852. These have been and will continue to be fiercely fought over.

Feingold lives where there is usually an abundance of water—Wisconsin. (I know because I was born and raised there).
Feingold dare not show up in the Western states and spout this proposal out loud.
He will not survive the subsequent week, IMO.

This is a Regulatory Taking of the value of your land and what you can produce upon it.

Well, today I wouldn't actually mind it if some bureaucrap said, "You cannot mow your lawn" - its over 100, but it has to be done. However, if they want to make that permanent, just let the petty-tyrants in the HOA know that they can't fine us for it - you know, one crime family moving in on the other's territory.

In all seriousness, this is yet another example of the feds trying to grab all of the marbles that we own, and then rationing them back to us (for which we should kiss their arses AND pay for it). It is simply getting to the point where we are owned - lock, stock & barrel - by the very federal government that We The People created in the first place. I just wish that the SOBs would be honest and stop referring to us as "citizens," and start referring to us as they really see us: tax serfs.

Oh, they should also be aware that not everyone reacts to an armed robbery by handing over everything in their pockets and being thankful to be left alone for cooperating. Some day these jokers are going to go too far, and that day seems to be getting closer every news cycle.
