Son’s 2nd shot kills intruder (Mississippi)
SUN HERALD ^ | April 25, 2009 | By KAREN NELSON

Javorous Darnell Tims, 20

PASCAGOULA — A woman, awakened by the sound of someone removing the screen from her bedroom window, got out of her bed at 1 a.m. Friday, walked to her son’s room and quietly woke him.

“She said, ‘Snigg get up,’” the son said in an interview later Friday morning.

“I got up, grabbed my gun and went to the corner there by her room,” he said, standing at the door of the apartment, on the bottom floor of the last in a row of Spanish-style buildings in the Granada Apartments on Chicot Road.

It was dark in the apartment, but the window was backlit, Snigg said. He heard the window go up and saw a man coming in.

“He stuck his hand under and pulled the blinds back, the blinds and the curtain,” he said. “And he eased in like he was attempting to come in.

“I fired two shots, then he ran off,” Snigg said.

Police say they won’t identify the woman or her son, who offered the nickname Snigg, for fear of retribution.

Javorous Darnell Tims, 20, ran about 80 feet from the window, fell to the sidewalk and died of a single gunshot wound, police said Friday.

Pascagoula police said Snigg and his mother acted appropriately, “taking the actions they felt necessary to protect themselves.” However, because a man died, the case will be presented to a grand jury for review.

With 500 foot spacing, you are probably OK with most anything. We have houses that are mere feet away, so I typically load with reduced power special purpose defense loads, shotgun and pistol. The defense loads are probably best, since they reduce recoil and blast which means that as the shooter, you can recover quicker. Don't underestimate the blast effect on you when firing a gun in an enclosed area, it can be severely disorienting for some time.

My main concern is friendlies in the house, you need to be aware where they are. So for that reason, you may want to load down.

You may want to go to one of those mobile trailer enclosed ranges to get an idea, if you have never fired a gun inside an enclosed space. Most defense shootings take place at distances of less than 7 yards, according to those who study such things. Our local trainers say this and recommend that you use that range and focus on gun familiarity most. They also recommend pistols as the primary defense arm, which I adhere to. It's too easy to get a long gun taken away in a close encounter, so they say.

Number 3 buck or even #2 bird shot is still quite deadly at close range. Either would be fine for defense. I use a compact pocket-able pistol in 9 mm with Corbon defense loads. With the compact, you can pocket the pistol if need be, and see what the commotion is, of course, situation depending.

The call 911 route first is best ... if you have the time.

As they say with opinions, everyone has one, so practice and make your own choices are generally best.

Tarpon, good point.
I often worry about over-penetration of ammunition if I ever have to defend myself in the apartments I live in.

Fellow Freepers, don’t they have special ammo for this type situation?
Thanks.

Amen panthermom.

I grew up in FL, lived in GA for 13 years and now MS for 1 year. I always assume that everyone else is carrying and therefore treat them and their property with respect.

An armed society is a polite society... or something like that.

Yes they do, it's called the Glaser Safety Slugs. Frangible rounds that break up against a solid surface.

One of the best places to get advice from is what do the air marshals use -- I believe today they are issued defense hollow point rounds. That's what I do.

Good idea, I have been in indoor ranges and they are not pleasant. Another consideration is that anyone within 10 ft. can kill/disarm you, even if they don’t have a firearm. My backup weapon is a .32 magnum Ruger, I think it is as effective as the .38 special (and holds one more round) and is far more comfortable to shoot than a small frame .357 magnum.

If you have a friendly local trailer range guy, ask him when he is the least busy. Then ask if he will turn off the lights for you to shoot in the dark. Try shooting with dark adapted eyes and see what you think of the result. It’s an eye opener.

And always equip your defense gun with tritium night sites.

The kid protected his mom.

It is a shame that the burden of killing a man was visited upon this youngster by this thug.

But if I was on the grand jury, no bill.

Have done that, was considering putting a tactical light mount on the shotgun, but haven’t done that yet.

Article says he’s a kid: so I guess missing on the first shot can be forgiven. Gun control, son...gun control.

Reporter makes stupid assumption. Kid fired twice, hit once. Could just as easily mean that the first shot hit, and the second shot missed because the perp jerked away at the first hit.

According to my CCW instructor, the number of missed shots fired by civilians in cases like this: 80%. The number of missed shots fired by LEO? 70%

sharkhawk said: "Grand Jury no bills, and he can't ever be charged again because of double jeopardy. "

I don't believe that is correct. A Grand Jury can issue an indictment or not issue an indictment. But they don't convict or acquit. If additional evidence should come to light later, I believe that the same Grand Jury or a different one is completely free to indict.

Grand Jury proceedings do not provide protections for the accused. There isn't any cross-examination or opportunity for the accused to provide a defense.

I would expect a firearms instructor to recommend shouting at the loser to “GET OUT”. Make it loud enough for the neighbors to hear. It may get the perp to leave. If not, then it helps creates a defense against charges for the homeowner.

The first shot was to startle him to make him rise up to get a better centermass shot with the second one. It was a strategy miss, IMHO.

Shooting is justified if you fear death or great bodily harm. Providing any kind of warning or not shooting for any reason, can be interpreted as NOT fearing death or bodily harm.

If a person is clmbing through one of my windows at 1am, I can't think of many innocent explanations.

Some people live in homes that can be mistaken for each other. A drunk coming home in the middle of the night and without his key might attempt to enter through a window.

The problem with giving the intruder the benefit of the doubt is that the intruder might be armed and just might choose to shoot at the sound of a warning. I would not want to make my children orphans due to such a misjudgement. I would opt to make somebody else an orphan.

The other problem with a warning is that it provides extra time for an intruder's accomplice to kill you or yours.

I don't remember any guidance to provide a warning in the defensive handgun course that I took. We went through drills involving "shoot / don't shoot" which involved taking time to identify the threat. Once the threat of death or great bodily harm was identified, we took two shots to center of mass and then considered a head shot if the threat remained.

Occupied trespassing as they euphemistically call it in ghetto towns is a hazardous occupation in my homestate
