Speaking at an anti-tax protest yesterday, the Texas governor brought up the fact that Texas had the right to secede from the union if thing in Washington got bad enough.
Now before we go further, let's set a little background:
Texans are fiercely prideful. You've probably seen the phrase "Don't Mess with Texas" before. It was originally meant to be an anti-littering slogan, but Texans have turned the phrase into a catch-all statement of the state's independent spirit.
Texans like to talk about independence and the fact that it's been part of six countries in its history.
That being said, it might be fun to daydream about what an independent Texas state would be like. There's a whole host of great country songs that could be its national anthem. Like, perhaps, Waltz Across Texas or All My Exes Live in Texas.
If it did secede, we hope that they can come up with something regarding Texas atheletics, so that the football teams can still participate in the NCAA. It'd be boring for the University of Texas (disclosure: my alma matter) to just beat up on Texas A&M every Saturday.
Here's one thing we do know. An independent nation of Texas would be energy independent.
Specifically, with respect to the supply of Oil and Gas. Would an independent Texas be able to produce enough oil and gas to serve its own population, with some left over for export ? Indeed it would. In fact, Texas produces more oil than any other state and accounts for 19.7% of total US output. Texas also produces more than 30% of US natural gas supply. Texas does consume a goodly portion of its own oil output, about 75% of what it produces. But, it only consumes half of its own natural gas production.

“I LOVE Sarah Palin!!!!!! (Michelle Bachmann too!)”
AMEN!!!!!! I love both Sarah and Michele as well! They’re both INCREDIBLE!!!!!
The U.S. Constitution is “fringe” by today’s standards.
Five justices were nominated by Lincoln during Civil War (probably replacing Southerners who left the Court when their States seceded); three were nominated in the 1845-47 timeframe. While it was a 5-3 decision, two of the dissenters were Lincoln appointees.
The case is still precedent; it has not been overruled.
Texas Governor Rick Perry Threatens Secession From The Union
Texas governor brought up the fact that Texas had the right to secede from the union if thing in Washington got bad enough.
I'm not so sure about that.
Per Tile 18, Part1, Chapter 115, Section 2383 (Rebellion Or Insurrection) through Section 2390. (Enlistment To Serve Against United States) of the US Code (as of: 01/19/04), Gov Perry and the Citizens of Texas would be committing Sedition.Granted, Texas's argument is that the US Gubmint has violated Texas' Rights under the the 10th Amendment (and the US Constitution in general) so 'The Pact' was already broken by the Gubmint in D.C. so Texas is a 'free' state.
So it sure would be interesting to see what unfolded if Texas and Texans followed through.
All that aside, I found something interesting in those sections, though is a tad off topic. It pertains to our buddies, the Democrats in Congress. And their anti-war cohorts like Code Pink and A.N.S.W.E.R. (and other assorted Commies)
'Section 2388. Activities affecting armed forces during war'It sure looks to me like the Democrats violated Part A, as all their demoralizing 'The War Is Lost' crap wasn't made in Congress so the Speech and Debate Clause doesn't protect them. And Code Pink and A.N.S.W.E.R. for SURE violated the rest.(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so - Shall be fined under this title or imprisoned not more than twenty years, or both.
(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).
(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.
(d) This section shall apply within the admiralty and maritime jurisdiction of the United States, and on the high seas, as well as within the United States.
These are all current Laws and Dubya could have had them all arrested for Sedition. Too bad he didn't, FDR would have... wait he DID. No dissent was allowed during WWII.
And it looks like Barry and his DHS moonbats are itching to put some people 'extremists' in camps. And with Eric Holder as AG .... well .... we'll see, won't we.
“The Constitution is not a suicide pact.” - Supreme Court Justice Robert H. Jackson, Terminiello v. Chicago, 1949.
Justices were from Ohio (2), and one each from New York, Pennsylvania, New Hampshire, Kentucky, Virgina, and Illinois. One of the Ohio Justices also served on the California Supreme Court.
They can do anything they choose with ‘their’ state government, (as long as it continues to conform the the US Constitution) but they don’t have a right to unilaterally do anything about the Federal government. That can only be done with the agreement of the other states as embodied in the US Congress.
Article 1, Section 1.
THE TEXAS CONSTITUTION
ARTICLE 1. BILL OF RIGHTS
Sec. 1. FREEDOM AND SOVEREIGNTY OF STATE. Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States.
Sec. 2. INHERENT POLITICAL POWER; REPUBLICAN FORM OF GOVERNMENT. All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient.
Sec. 3. EQUAL RIGHTS. All free men, when they form a social compact, have equal rights, and no man, or set of men, is entitled to exclusive separate public emoluments, or privileges, but in consideration of public services.
Palin-YES,
Perry- NO. He's a globalist RINO
All other transgressions aside, I’d say that the Obama Stimulus Package pretty much violates Art. 1, Sec. 1. as the right of local self-government has now been abrogated by the Feds.
Too funny, ROLF! That's most of Austin!
Amen
oh yes.....he is pusing hard for the highway (from hell). He has made numerous trips to Mexico kissin up trying to pave the path. He made trips also abroad working for super connector, that went nowhere. And signed an executive order that all 13 year old girls must have that shot (the new one that is suppost to stop a virus that leads to cancer, can’t remember the name) but oh boy he caught HELL big time for that one. It did not take long for him to retract his order. He has dragged his feet on the border fence, one time yea, next time nay...what he says just depends on who he is talking to.......we don’t need Kay Baily nor Perry, we need some good fresh conservative to run for Governor.
Still did not address the actual power behind it, i.e. it having as much authority (none) as a similar ruling from a British judiciary in 1776.
Not to mention the fact that placing all power with the SCOTUS has given us a country no longer bound by the Constitution, but by the whim of five SCOTUS members, many of whom have admitted that they view the times (or foreign law) as a guide to their decisions, rather than the original intent of said document. You look to the law as a guide when we are now a nation of MEN, men who advocate the reduction of true liberty at every turn.
I will not vote for Perry again....he is a snake in the grass, as far as I’m concerned.
And no, not Kay Baily either
We need someone new who is a REAL CONSERVATIVE. And if we don’t get someone new....that fence will never be built...
No, it was not sedition which is simply talk. What they did was outright treason against the Crown and every one of them knew that the Brits would have hung them if the revolution had failed. They pledged the lives, their fortunes and their sacred honor. It was not some legalistic game to them. Treason is very serious and deadly business in that age or in any age.
I say Rick Perry for President! THIS is the kind of outrage and message that is riling the party!! I hope he stands up demonstrates seceding from the union and then runs for President!!! WE need real leaders that demonstrate their anger and ways to fight this socialism and the Left and is not scared to speak up or be agreeable!!!!!
I think what folks outside Texas miss is that while Texans are stubborn, they ain't stupid. We tried secession back in 1861. Didn't work out so well — even though Texas was the only state that chased the North out of the state by the end of the “late unpleasantness.”
Nah. If it comes to fightin’ over preserving American freedoms, Texas won't secede. Rather, it will lead the liberation of the rest of the US of A. Even though — just like when we liberated Iraq — there may be some opposing liberation.
We'll just borrow what helped the North win the “late unpleasantness.” There will be those willing to fight for liberty and union in the “serf” states, just like the North raised hundreds of thousands of troops from the slave states during the “late unpleasantness.” May even help form an “East California” out of the red part of that state - just like the United States got West Virginia as a result of the “late unpleasantness.” (That will give us San Diego as a port for the navy on the left coast.)
It will be “Texas! Liberty! and Union!” and we will make “Battle Cry of Freedom” our theme song.
As a native born 6th generation Texas, I say Welcome!!!
We have three choices; secession (divorce), we can expel the lefties to the socialist utopia of their choice, or we surrender to the statists. With the first two choices, America remains America. With the last choice, America becomes Europe.
The Left will never surrender. They will never give up. They will continue to push us into Communism if they stay.
