Tax troubles for president's chief of staff

Emanuel's rent-free Washington residence draws questioning

There could be tax troubles on the horizon for White House Chief of Staff Rahm Emanuel, who reportedly has lived rent-free in Washington for five years but hasn't paid taxes on the imputed income from that, according to reports.

He's the latest in a growing list of President Obama's nominees to have been involved in tax issues, according to those tabulating the tally in Washington.

According to WND columnist Phyllis Schlafly, several of "Obama's major nominees are mired in political embarrassment. Three withdrew their names from consideration, one sneaked through confirmation because senators were still intoxicated with the Obama honeymoon, and Obama plans to use a waiver so the Senate will approve the fifth."

"Funny thing," she continued, "Americans don't seem to like it when government officials evade the taxes the rest of us pay, especially when they evade more taxes than most Americans' entire tax bill. Apparently, that doesn't seem to bother Obama."

If Raul, had legal residence elsewhere and his employer needed his presence in the D.C. area on a consistent basis, providing him with a place to stay would be the employer’s expense and taxable to the employer, not the employee.


That would be true if (like a nanny or caretaker) he had to live in that particular place in order to perform the work. But simply providing him a place to live is a taxable benefit, same as meals. It’s a close case as you phrase it, and it he had been reimbursed for hotel costs, the reimbursement would be non-taxable.

EXCERPT News broke last week that Obama's COS Rahm Emanuel lived rent-free for years in the home of Rep. Rosa De Lauro (D-Conn.) - and failed to disclose the gift, as congressional ethics rules mandate. But this is only the tip of Emanuel's previously undislosed ethics problems. One issue is the work Emanuel tossed the way of De Lauro's husband. But the bigger one goes back to Emanuel's days on the board of now-bankrupt mortgage giant Freddie Mac.

Emanuel is a multimillionaire, but lived for the last five years for free in the tony Capitol Hill townhouse owned by De Lauro and her husband, Democratic pollster Stan Greenberg. During that time, he also served as chairman of the Democratic Congressional Campaign Committee - which gave Greenberg huge polling contracts. It paid Greenberg's firm $239,996 in 2006 and $317,775 in 2008. (Emanuel's own campaign committee has also paid Greenberg more than $50,000 since 2004.)Greenberg had polling contracts with the DCCC before - but each new election cycle brings its own set of consultants.

And Emanuel was certainly generous with his roommate. Emanuel never declared the substantial gift of free rent on any of his financial-disclosure forms. He and De Lauro claim that it was just allowable "hospitality" between colleagues. Hospitality - for five years? Some experts suggest that it was also taxable income: Over five years, the free rent could easily add up to more than $100,000. It is also a “family court” term. You can be unemployed or even “under-employed” and the court will base your child support on “imputed income” - what THEY think you “could” earn. Fun, huh?

It is what turned me against this country. It was 12 years ago. I am STILL a “sleeper”. We are legion and they really do not want to wake us.

Yup----Obama is orchestrating a "palace coup" against his COS........easing Rahm out the door. Rahm's office was already moved out of the WH..........a president usually has his COS next door to him at all times.

The knuckle incident was gross insubordination to a president.

And those official admin pics------no president likes to have a COS who attempts to overshadow him. The pained look on Obama's face as Rahm hovered over him that first hour in the Oval Office was VERY telling.

Arrogance personified.

Obama at a meeting earlier in January with House Speaker Nancy Pelosi and others complained to Emanuel about his tendency to loudly crack his knuckles. “At which point,” The Times reported, “Mr. Emanuel held the offending knuckle up to Mr. Obama’s left ear and, like an annoying little brother, snapped off a few special cracks.”

Now all questions aside about (insubordination) and the propriety of doing that to anyone, much less the President of the United States.....Obama’s reaction was not reported...probably in keeping with “the cool, collegial and deliberate culture of Obama World.”

I did catch this on another thread - different source same subject.

Now don't get mad (kidding) but I think this 'imputed tax' thing and Rahm may be, wrong.

From my interpretation of the Tax Code(1) it's not Rahm, but the Apartment OWNER (forget her name) who has the "Imputed Income" obligation.

It was she who let Rahm live rent free while she could have rented the same space to 'Joe Blow' for $x,xxxx.xx per month. As reported, over five years she would have had an additional 'real' income $100,000.00 to pay taxes on. That is "Imputed Income" and would be her responsibility.
That being said, Rahm's tax obligation for living rent free, if any, would be as if he had a 'Company Car'. In the good old days a Company Car was a tax free benefit for execs and top managers. Then Congress closed the "loophole"(/s) and the Value of the Car is now taxable. Companies then stopped 'giving' the cars and replaced that with 'car allowances'. Rahm would then have to file, IRS form 2106 Employee Business Expenses.

EXCEPT he's not getting the 'Free Rent' from his Employer. So I don't think he owes anything. Unless of course we go into the "GIFT TAX" section?!?

Wow, this is getting complicated. Maybe 'we' should check with the guy who writes the tax laws... Charlie Rangel! ....
