The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.
The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.
WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.
The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

Ah, thank you for answering my question. I should have thought of the identity theft aspect.
why doesnt the RNC throw their money behind these lawsuits ?
I think he’s legal and the DEMS are playing a game with the Pubs. If the GOP sues, out comes the birth certificate and WHAM...it’ll hit like a 2x4 across the face for the RNC.
I’m still convinced North Carolina, Virgina and Florida without ACORN is much much closer, and even in McCain’s column.
Look what’s going on right now with Al Franken with votes popping up and they don’t show any evidence of say Obama getting more votes on the same ballotts though.
I will pray for deliverence and mere riots instead of a full blown civil war between now and 1-20-09, but if the zero does become the 44th president I will extend every bit of cooperation to him that the left has given to Bush the last 8 years.
Maybe so. But already Obama looks like a lying sociopath.
tpanther, you said, “I will pray for deliverence and mere riots instead of a full blown civil war between now and 1-20-09, but if the zero does become the 44th president I will extend every bit of cooperation to him that the left has given to Bush the last 8 years.”
I like your strategy. I will pledge to stand with you. It makes sense to me and I can live with it!
Source.
Former judge Napolitano explained the procedure; I heard him on a radio station hosted by Mike Rosen of KOA and I read an account of it I believe in the WSJ.
He said: The Senate clerk will ask for the electee to provide proof of his age, legal residence over the past 14 years and proof of birth which he said, George Bush provided by submitting his passport. Napolitano was grilled rather strenously by Mike who is a very intelligent and forceful conservative radio commentator in Denver.
He further said that probably the only person with standing who could challenge Obama would be John McCain who could sue and probably would be heard by the court. If John does not do so, which I believe will be the case, Obama will be elected by the electors and after that if Obama is found to have lied under oath or submitted a false document, he will have committed a felony which can’t be prosecuted because a sitting President cannot be prosecuted, he must first be impeached which won’t happen no matter what with a majority Democratic Congress.
I think you can kiss all this birth certificate business good bye.
That is interesting- Thank You.

Scroll down to 10/28/08 and you can listen to the Judge Napolitano discussion re Obama birth certificate.
There appear earlier discussions with other people on 10/27 and 10/26 I believe - for what it is worth.
IIRC this was before Keys got involved. He also was a candidate and therefore has standing.
Yup, liberals say they’ll reach across the aisle and yet they never ever do, meanwhile liberalism is destroying the country, indeed western civilization. SO there’s two reasons to never cooperate with liberals, the second being the most important.
According to Napolitano, Keyes wouldn’t have standing it would appear because he said Barr and Nader wouldn’t either.
If anyone chose to listen to Judge Napolitano’s explanation regarding proof of birth re Obama at: http://www.850koa.com/cc-common/podcast/single_podcast.html?podcast=shows_rosen.xml
I was mistaken re the other discussions by Bruce Fein and Ken Timmerman - they occurred on 10/28 also - three hours altogether.
“My Ancestry: Late Father - American of Irish Ancestry, Mother - American of Japanese Ancestry./Just Asking”
So you get stubborn and good natured from dad and ordered and smarts from mom?
Could be worse DNA to go thru life with!
Well, that explains it all: the Irish part of me: partial to good single malt whiskey, when the mood strikes and definitely up for a good fight, given good cause and reason. The Japanese part explains the orderly, Zen - quiet side of me./Just Asking - seoul62......
They once were, but no longer, at least in most states. Not because of "privacy" as some would allege, but rather because of the problem of identity theft.
And it will be more effective to oppose it with rationality and composure.
I take that back, the passport shows place of birth, and so is sufficient.
Of course you have to submit a birth certificate to get a passport, or other official documentation of place of birth such as: (From state department website):
Previously issued, undamaged U.S. Passport
Certified birth certificate issued by the city, county or state*
check box Consular Report of Birth Abroad or Certification of Birth Naturalization Certificate
Certificate of Citizenship
*A certified birth certificate has a registrar's raised, embossed, impressed or multicolored seal, registrars signature, and the date the certificate was filed with the registrar's office, which must be within 1 year of your birth. Please note, some short (abstract) versions of birth certificates may not be acceptable for passport purposes.
A quick search did not reveal which short form BC's were and which were not acceptable, except that California's and Texas' are not.
“Scroll down to 10/28/08 and you can listen to the Judge Napolitano discussion re Obama birth certificate.”
I don’t know about Napolitano sometimes ... he said that the Clerk of the Senate verifies age, citizenship, etc. after the electoral votes are counted.
I have searched United States Code Title III, Chapter I: Presidential Elections And Vacancies - there is NO provision for the Senate Clerk to do ANY such thing.
He also said that NO Presidential candidate, other than McCain, would have standing to challenge in court - Bull Hockey!!!
Cheers!
