The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.
The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.
WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.
The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

Regardless of how it would go down, and who is at fault, the republicans fear they would lose the black vote forever.

Maybe the outcry for Obama’s birth certificate DOES need to come from them. Alan Keyes needs to grab the spotlight on this one.

Well then, i guess so.
Not if it comes out before the electors cast their ballots. If he were found to be ineligible before then, the electors could then vote for whomever they wanted, although they would still be committed to vote for Biden for VP, in those cases where state law requires them to vote for the candidate they are pledged to, which is not the case in all states.
If it happens after that, but before the President of the Senate opens the reports from the state electors, then the Constitution requires that the House select from the top three electoral vote getters, which would mean McCain, once The One is taken off the table, since no one else got any electoral votes. If the House did not select a President by January 20th, the Biden would act as President until the House finally does select one, which still must be McCain.
Anyway you cut it, from this point forward, if Obama is shown to be ineligible were are in Terra Incognita, and there be dragons there.

He was only on the California ballot.....IN only had two listed and then a blank for the write ins.

If Hussein is sworn in ... a class action suit by milllions of taxpayers might be in order.
First, sue every official who can not testify that they saw a COB and then certified the election anyway. That action alone constitutes fraud.

Oh, wow, I missed that. Keyes fights like a crazed Tasmanian Devil, which is why he's a really lousy campaigner, but the guy knows the law and constitution very very well.
