On what basis can they throw 8 out?

It already went to court before the election and the anti-8 people were denied and the vote went ahead.

It can’t be called state unconstitutional again because 8 is an amendment to the constitution. The only thing left is claiming its unconstitutional under the federal constitution. If they do that then it goes immediately to the SCOTUS. If the SCOTUS finds that banning gay marriage is unconstitutional then all state bans across the country are thrown out.

They won't overturn Proposition 8 because they remember what happened to Rose Bird. If the Justices are perceived as putting ideology ahead of the law, they could be out of office in no time.

The California Supreme Court's surprising announcement that it will quickly review the legality of Proposition 8, banning gay marriage, has prompted growing speculation that the four judges who found a right to gay marriage in the state Constitution in a May ruling will quickly throw Prop. 8 out.

The ballet initiative already has been reviewed by the courts has it not? The proposed amendment to the Constitution was approved by the people. On what basis can they trash the legality of Proposition 8? Has it not already been vetted? The eager legal beavers already threw out Prop 22; telling the people that they had to get an amendment to the Constitution. The people have the amendment; now they are going to throw that out too?

What kind of doubletalk are the judges giving now? Is this a "Mother, May I" kind of thing, so the people of California have to go back to the end of the line, and start over for the third time?

The Libs are really aggravating many Blacks (even Lib Blacks) by trying to claim the civil rights struggle of gays is the same as the civil rights struggle of Blacks.

Out of curiousity - I heard that Mormons (LDS) were very big at pushing Prop 8. I met a few of them before and they were very nice people.

Pisses me off how some Christians got on Mitt for being a Mormon. It was also the bigoted Dems too.
