They won't overturn Proposition 8 because they remember what happened to Rose Bird. If the Justices are perceived as putting ideology ahead of the law, they could be out of office in no time.

“Rose Elizabeth Bird (November 2, 1936–December 4, 1999) served for 10 years as the 25th Chief Justice (and first female Justice & only female Chief Justice) of the California Supreme Court until removed from that office by the voters. Bird was targeted by well-funded conservative and pro death penalty groups whose withering attacks painted her as a soft-on-crime liberal. After being outspent two to one, she lost her reconfirmation bid and left office in 1987.”

Thank God there is no bias at Wikipedia or this entry might have sounded anti-conservative

If they apply the law, there is no way they can overturn Prop. 8, even though they voted for homosexual marriage. The legal issue before the court is different. The legal issue is: does Prop. 8 constitute a revision of the constitution, or is it just an amendment? If it’s a revision, legally speaking, then it could be in conflict with the rest of the constitution, and the legislature would have to start that type of process. Which the Dem. legislature would never do.

If they apply the law, this is a no brainer. If they use political correctness as the guide to what the law should be, then they would overthrow Prop. 8.
