Let them throw it out, and we cab start a massive recall effort to remove the judges and now the gaygreen Governator.

In just a week, many Californians and Americans are being subjected to Hate Crimes brought about by criminal gay deviates.

We don’t march and threaten gays with axes, axe handles, ball bats and other weapons. As done by Hate Filled Gays in a church as shown in the picture linked below:

Arnold did roids when he was younger. I think they all did with the exception of Steve Reeves back in the early 1960s or late 1950s. Reeves probably was the perfect natural body builder. The later roid heads look like freaks.

Costa says he's already been contacted by some of the folks who would seek to recall Ronald George, Joyce Kennard, Kathryn Werdegar and Carlos Moreno if Prop. 8 is scrapped. He thinks it's premature and risky because talk of a recall "would just (bleep) off the judges."

Costa also doesn't sound like he's too thrilled about such a recall, saying it wouldn't be "healthy."

Yes, Costa. Let's not let the anger of a few warped judges thwart the will of the people in a "healthy" democracy.

It would be risky to flaunt this notion of a recall BEFORE their decision. Once they decide, the ball is in our court.

It’s not these guys overturning it, its the CONSTITUTION.

You cannot make exceptions just because you don’t agree with someone morally. and you CAN’T vote on civil rights, majority DOESN’T always rule, and you CAN’T allow on group of consenting adults to marry and deny another group of consenting adults. Civil unions are NOT good enough. PERIOD. That is why SEPARATE BUT EQUAL is UNCONSTITUTIONAL as well.

You are afforded the liberty to believe what you want, the Establishment Clause forbids the passing of laws based on religious beliefs.

It BETTER get overturned and everybody should be happy because if it’s not then this country is headed to a baaaad place and we may as well throw our constitution in the pooper.

Did you just get off the boat yesterday? Or did you fail civics class? This is not about the things you suggest. Rights? This is about sex only. They want to have sex, and they want their sexual acts to be forced on the rest of the people. So, I exercised my right, as a US citizen, and voted. They want mob rule, by protests, threats, attacking churches, people, and destroying property. We call this civil disobedience. This is a constitutional amendment, and it passed.

On the amendment v. revision issue, it is important to look at the relevant case law. In People v. Anderson (1972), the California Supreme Court had ruled "that capital punishment is both cruel and unusual as those terms are defined under article I, section 6, of the California Constitution, and that therefore death may not be exacted as punishment for crime in this state." In that same decision, the Court noted that the "cruel or unusual punishment clause of the California Constitution, like other provisions of the Declaration of Rights, operates to restrain legislative and executive action and to protect fundamental individual and minority rights against encroachment by the majority. It is the function of the court to examine legislative acts in light of such constitutional mandates to ensure that the promise of the Declaration of Rights is a reality to the individual." Later that same year, voters passed an initiative which constitutionalized the death penalty. This initiative affected the right to be free from cruel and unusual punishment, a right of a minority. Lawyers for Lavelle Frierson, in their appeal of his death sentence, argued that the initiative amounted to a revision. The Court rejected that argument in People v. Frierson . So case law states that amendments can be used to reduce (and extend) the scope of the cruel and unusual punishment clause.
