The arguments ACLU et al are using in their case are the same ones they used to try to keep this off the ballot before the election. The court rejected the arguments then. Let's see if they respect stare decisis, indeed, their very own opinions! I do not have faith that they will.

California sales tax is currently 7.25%. An addition of 1.5% would make it 8.75%.”
There are 58 counties in Kalifornia.
They can set their own tax rates.
There is a base rate- which I don’t know the current amount.
If Arnold is trying to make the base rate as high as 8.75%, then the counties rates would be on top of that.

Sam here in Ohio we passed a constitutiona amendment in 2004 and so far it still stands. I don’t think the court can do much about this other than refuse to hear it. 30 states now have the same thing and so far none hve been overturned. The other 20 need to get busy so this issue can finally be put to rest for the next century or two.
