Calif. gov.: 'We will maybe undo' Prop 8

California Gov. Arnold Schwarzenegger Sunday said "we will ... maybe undo" a measure passed by voters Tuesday stripping same-sex couples of the right to marry.

Proposition 8 amends the state constitution to declare that "only marriage between a man and a woman is valid or recognized in California." It came in reaction to a state Supreme Court ruling that laws prohibiting same-sex marriage violated the state constitution.

In an appearance Sunday on CNN, Schwarzenegger said the state Supreme Court might overturn Proposition 8, the Los Angeles Times reported. He also said it is likely Proposition 8 will have no effect on the estimated 18,000 same-sex marriages already recorded in California.

"It's unfortunate, obviously, but it's not the end," Schwarzenegger told CNN. "I think that we will again maybe undo that, if the court is willing to do that, and then move forward from there and again lead in that area."

The law is in effect right now. Under Calif. law, constitutional amendments become effective immediately. All of the local county office stopped issuing same-sex marriage licenses last Wednesday or Thursday.

So, the restored definition of marriage is being adhered to, pending decision from the Supreme Court again.

correct me if I am wrong please but does this mean that those like Ellen cannot say they are married?

Here in FL I do not like some laws, I hate paying tax but I live with it.

I lived for a time in MA as my wife is from there and we moved out of that state, why? Because we did not like the laws or the politics.

I would suggest that all these who do not like the laws of their state move to a state which is more in tune with their views and agenda’s.

That is the beauty of this country, people can move where ever they like.

The legal status of Calif. same-sex marriage that happened before election day has not been settled. It would likely take a court ruling to clarify their status, as to whether the Proposition 8 amendment is retro-active or not.

It’s important to note also that this applies to Calif. marriage only. Ellen and Mr. Sulu and the others are single and have always been single under federal law, because the federal gov’t doesn’t recognize homosexual marriage.
