(Lafayette Hill, Pennsylvania – 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.

Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.

This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?

So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.

According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

Bill Richardson, Chris Dodd, even Joe Biden too, along with the other bunch of Democrat also-rans for their party’s nomination would have standing at this juncture and leading up to it.

According to the courts we the people have no right to question the Constitutional Eligiblity of a candidate for President.

That has to be changed... Only bodies that can do it are Congress OR the SCOTUS.

Its my belief that Obama is a NATURALIZED citizen which is what that attack dog McCaskhill tried to get that clause into the recent legislation that actually referred to McCain. Thankfully it didn’t work. Wonder why Obama’s favorite spin-dog wanted THAT in there...

He is going to ask the SCOTUS to change the law in essence. To make it possible for the average person to question the qualifications of a candidate for President. This is either a Pandora's Box, or a chance for the average Man to have a say with just cause to do so.

Wouldn’t a better “harm” in the case be the possible disenfranchisement of Berg’s vote? If Obama is not eligible to be POTUS and Berg is a Democrat, isn’t there a chance his vote and others would be null and void if after the election Obama is disqualified. Possible vote disefranchisement should give Berg standing before the election.Congress can make new laws later.

Surrick stated that his court has no jursdiction to decide the matter, and he also based his decision on Standing. Berg is going to be appealing to the SCOTUS, and doing so he is going to have to prove he has standing to do so. That means SCOTUS will have to rule that he DOES have standing which will CHANGE Legal Precidence. It will change the law. So you want to back up your assertion?

If the average person is a citizen of the republic, he has a right to know if the candidate is qualified. He has a right to make sure that the election is run fairly, in fact that is is DUTY. Not the duty of the government or government lawyers or crooked politicians! That's why they are supposed to have students read the Constitution in school. It is so that you know you are SOVEREIGN, and the government has power over you only if you ALLOW it. To allow a foreign national or otherwise unqualified person run for office and take money from foreign governments or foreign sources to fund it is the essence of anti-Americanism.
