The Court is supposed to be a co-equal independent branch of government able to decide Constitutional issues. For the Court to rule that they are not equally able to read the Constitution and need Congress do decide what it says in regards to eligibility is nonsense.

I wonder what if someone from Congress had brought this lawsuit to the Court? Would they still not have standing? Would they have more standing then a citizen? This is a ridiculous ruling.

It seems to me that prior to the election the only person with standing is Hillary Clinton.

Comments from Jeff Schreiber-this is why we need to call on Congress!

Call on Congress?

The answer is to nominate a Presidential candidate who talks about conservative issues unashamedly and does it with a smile and some humor....and then follows through.

If the press had raked Reagan about the cost of his wardrobe he wouldn't spend time defending it....he would pop their balloon with "Well, you sure wouldn't want to see me naked." or something and that would be the end of it and the people would love him for it.

If you say read my lips, keep the promise. If you establish a "Contract with America", follow that contract to the letter.

None of the gimmicks work very well. Lawsuits, impeachments, nude pictures of momma, turban pictures. You can't win an election solely attacking your opponent.

Go back to what works. Reagan is a good model.

“So, who does have standing? According to the Hon. R. Barclay Surrick, that’s completely up to Congress to decide.”

This just tells us that now we know who really runs this country. And it’s certainly not “We the people”.

Well, please tell us what forum would “the people” that it’s up to go to get the proof that this man is eligible for President?

It’s up the the people, so what do the people do?

Are you saying it’s ok that he isn’t eligible, as long as he is voted in, the constitution doesn’t matter?

I am putting out a plea. Can two constituitanal lawyers please, please post plain, commonsense arguments to both sides of this issue. I would appreciate seeing it as a separate post, and in a format that could be presented to local newspapers. A brief history would also be helpful.

This seems to be a huge issue, but only because Obama refuses to release his birth certificate.

As a matter of course, all parties should submit their birth certificates - including Sarah Palin and Joe Biden... John McCain has already presented his.

I am not super good on a computer, but I would cut an paste both sides of this argument and submit them to my local newspaper.

“To reiterate: a candidate’s ineligibility under the Natural Born Citizen Clause does not result in an injury in fact to voters.”

Wow! Having a whole country stolen by a foreigner is not sufficient injury?!!

No I am and apparently the judge is saying if he isn't eligible then don't vote for him.

This is a question of the constitution. If the courts hold to the position that we do not have standing to have the constitution enforced save for those which congress decides to give us then we have reached a dire precipice.

The government may need to be reminded that it exists by the consent of the governed and not the other way around.

And those who by their blood established both the declaration and constitution and defended it all these years do not deserve to have us sit idly by and let their deaths have been in vain.

This must be vigorously persued.

If Obama is not Constitutioanlly eligible to serve as President, then any tax increase measures that he signs should be ignored and challenged in court. All active duty military should refuse to report to a CiC who is not Constitutionally eligible.

This would be more what would be expected of the leftist as a response. We should not encourage people to step down and not defend the nation.

I would just hope that more people demand justice from their representatives and show their outrage. We have a right to know!

“The judge is saying if he isn’t eligible then don’t vote for him.”

And how is a person to that since Obama is totally uncooperative in providing proof of citizenship?

Had Obama a birth certificate, he would have produced that.

The judge lifts shell number two and voila no pea.

It is not proof of Obama's satisfaction of the natural born citizen clause in Article II USC.

It is proof how difficult it is to infuse constitutional principles into a political sea of jellyfish.

Plan B is to infuse a barracuda.
