Panel: Palin abused power in trooper case

ANCHORAGE, Alaska (CNN) -- Republican vice presidential nominee Sarah Palin abused her power as Alaska's governor in the firing of her former public safety commissioner, but violated no laws, a report for the state Legislature concluded Friday.

Public Safety Commissioner Walt Monegan's refusal to fire Palin's ex-brother-in-law from the state police force was "likely a contributing factor" to Monegan's July dismissal, but Palin had the authority as governor to sack him, the report by former Anchorage prosecutor Stephen Branchflower states.

Are they just ASSUMING she also had a grudge?

She needs to call a press conference LIVE, give a brief synopsis the Trooper's actions (the tasering, etc.) read the nasty, threatening emails he sent her, and look right into the camera and ask America point-blank if We the People think her actions on transferring (not firing) his do-nothing boss was justified and state that the Trooper was not fired, even after all this. He was armed, he was dangerous and obviously mentally unstable and his boss abused his power by not getting rid of this bad apple.

See, we know the truth about this, but there are many Americans who do not and will take the AP's spin at face value.

Nip it in the bud, Sarah.

I have was disappointed with Steele tonight too. As far as the panel went, only one was telling the truth about Obama.

I have bounced up and down so often lately in feeling hopeful when McCain got tough and then crashing when he acts like he is giving in!

Have decided to hand in and see what happens Monday when Hannity has Corsi on with documents showing the on going connection between Obama and Odinga of Kenya. Also waiting for whatever happens with the Phil Berg case. Obama could end that thing with his original birth certificate and proof that he is no longer has dual citizenship, but is still fighting releasing any information. Then there is the debate Tuesday when McCain should nail Obama “face to face”.

I have to hope McCain gets fired up again. Rush said not to panic yet, but it sure is hard not to!

I agree. Pray for her right now.

I not only pray for her, I've been going on a half-day fast (12 hours) since the 40 Days for Life campaign started. I've been encouraging others to fast and pray too, like Esther did.

Maybe we'll ALL have to go on a three-day fast just before the election...if we have the stomach for it (pun intended).

Look, we have to face the fact that McCain will be McCain and no one's gonna change him now. We're stuck with him. With only a few weeks till election, we have to quit picking John's bones and go on full frontal attack on Obama.

Scoring brownie points on these threads against the Senator isn't going to do a damn bit of good. Spending time, energy and money to DEFEAT Obama and save our country is the ONLY thing of importance now.....McCain has become almost a sad footnote to a November election event which can be cataclysmic for our country and our children.

WORK TO DEFEAT OBAMA.......IT'S OUR ONLY HOPE.

(....and pray John will be inpired in the last debate. Our prayers for Sarah in her debate seemed to help).

The panel concluded nothing from what I understand. They voted to release the report.

I stand corrected. That was Branchflower's conclusion in the report.

This is such a great point. How does asking this man to take another post in her cabinet....because she did NOT fire him...produce a benefit to her personally? Did the next commissiner of safety fire the BIL? No. He is still a trooper, sadly. Did she ask the next safety commissioner to fire the BIL?

Do you have access to the photo of Branchflower et al at Obama headquarters?

Here is the infamous picture, just in case you haven't already seen it in the thread. Branchflower isn't among those pictured.

No. The person who wrote this report, is a former co-worker and friend of the guy Sarah transfered. She didn’t fire anyone. And tell me how she benefited personally by his removal from Safety commissioner???

The man sent her very disrespectful emails. He is accused of abusing his exwife....he has problems with women, obviously. I hope the publisize the emails he send to Sarah. It is the only way to clear this up.

From what I can see, that was a judgment call based on the idea that she achieved some personal benefit from the termination of Monegan. It would likely be unethical if Monegan were a model employee, but he wasn’t. Since she had legal standing to remove him as well as practical reason to do so, that judgment is pretty much wrong.

I think I would sue any agency that kept reporting that she "unlawfully" did anything...truth is, she did not break any laws at all....none...

Pardon me for coming to this discussion late. (I haven’t posted on FR in years; still lurk quite often, though.)

Does anyone have, know of, or have a link to, a legal definition of this phrase or these individual words: “...effort to benefit a personal or financial interest...”? Preferably from the Alaska Statutes, but at least from some other legal authority recognized in Alaska?

I’ve had one Palin critic tell me her “personal benefit” was ... get this ... vengeance.

From another thread that was talking about this, I don’t think the abuse of power had anything to do with the firing. (As Gov. of Alaska she can fire numerous types of public servants for no reason at all).

I think the abuse of power was a phone call!

It seems that Sarah called Colonel Grimes (head of the troopers I think) to see what was going on in the investigation of the Crazy Drunk Tasering Poacing Trooper Wooten. However, because it was still under investigation he couldn’t tell her anything. (Note - the report does not say she kept calling, threatened him, etc.)

However, that call, coming from the Governor (I don’t suppose saying upfront “I’m calling as a private citizen.. my sister in law is...” would work!?) was the betrayal of public trust (”any effort to benefit a personal...interest”)

From the recommendations section of the report:

In this case there has been much said about the level of frustration that existed on the part of Sarah Palin’s father Chuck Heath who filed the original complaint against Trooper Michael Wooten, and on the part of Sarah and Todd Palin, who attempted to learn the status of the investigation only to be told by Colonel Grimes that the matter was confidential by reason of AS 39.25.080. I believe their frustration was real as was their skepticism about whether their complaints were being zealously investigated...

From the findings section:

“The legislature reaffirms that each public officer holds office as a public trust, and any effort to benefit a personal or financial interest through official action is a violation of that trust.”
