Is a grand jury required to indict or is some prosecutor just covering his behind?Not only is a grand jury required, it must be a federal grand jury, since the crime is a Federal one.
I tried a quick search to identify the current members for the Chatanooga district, but no luck so far.
I do not believe that the members can be "secret."

How in the world did a grand jury get it this quickly, they just served the warrant on Monday, and generally, Grand Juries serve for a week or two at a time? In my neck of the woods (Indianapolis), grand juries are typically already seated, and serve for nearly three months (a quarter of a year). This way, should something important come up, they could quickly review evidence and decide (or not decide) to recommend an indictment.

Is a grand jury required to indict or is some prosecutor just covering his behind? No, a grand jury is not required to rubber-stamp a prosecutor's view. They would be totally pointless if that were the case. That said, the standard for indictment is pretty low if I remember correctly.
You may have been asking if it necessary for a grand jury to meet and agree before any indictment is handed down. I don't believe so. I think a prosecutor who feels he has a strong case can indict without one, but I'm not sure.
Freepmail me if you'd like an example of a grand jury which did not indict on recommended charges.

What if the stupid stunt was breaking into your house? The law is the law.

Its been over a week since the kid was outed on the web. Plenty of time to wipe his hard drive and clean the house of any incriminating evidence. The FBI has the log files from Yahoo and the hacker's ISP. The operator of the proxy server has turned over his log files and is cooperating.
There is no point in getting in an uproar if the indictment isn't handed up today. If David Kernell was the hacker, he will be indicted soon and brought to justice. If his roommates took the fifth, they'll be given immunity and compelled to testify.
The more interesting question is whether the FBI can catch the other hackers who logged in after the first one disclosed the changed password.
