State police say they arrested a man early Tuesday whose blood alcohol level was 0.491 percent the highest ever recorded in Rhode Island for someone who wasn't dead.

They should have checked the alcohol level in the car, it’s probably 80 proof Chivas Regal, LOL

Or argue that this level is so "impossibly high" it must be an error in the test -- and move to have it thrown out entirely. If this subject was actually operating the motor vehicle , I would say your proposition is the most likely . If it was a physical control type violation then maybe just a new world record .

There have been higher BAC’s recorded in other states. People who sit around and drink two quarts of 90-proof a day tend to have a high tolerance. I don’t know how they do it. An 18-pack of light beer is about all I can do without passing out. Hard liquor/mixed drinks make me wish I were dead the next day so I no longer drink them, other than a shot of good tequila or a bloody mary every now and then.

We’ve seen them with 1.00 and still ticking. Not walking but alive. We routinely see over 0.50 g% in walk-ins to the ER. These results are by gas chromatography not breath with using an Intoxilyzer or some other brand.
We have very healthy livers down here.
