Bush and Cheney tried in 2002. The Republicans voted strong for it the Democrats strong against it. You need a supermajority to win. The Democratic position of Phase 1 - conserve, Phase 3 - Energy Independence is being exposed as a sham, because what the hell is Phase 2?!?!? The good news, this will force government out of the way although I would wager a lot of this ignorant mental dwarves in Washington won’t be thrown out until 2012 and they will fight it tooth and nail in-between.
Refining capacity is a huge problem..... but the root of this problem lies more with the simple fact that the demand in oil is rising faster then the supply can keep up.
Believe it or not, speculators are getting crushed right now..... they’re in trouble.... here’s an article that will give you an idea of the squeeze they’re feeling right now:

It is a political ploy to put more pressure on Congress. They Democratic leadership in Congress keeps trying to point the finger at Bush for the high oil prices.
This is Bush's way of pointing back and making it clear that it is not his administration getting in the way of increased domestic oil exploration and production, and trying to force Congress to act.
Bush and the minority Republicans in Congress are trying to force a vote on the issue. They want the Democrats to go on record opposing increasing domestic oil production in an election year with soaring oil prices.
The Democrats, with the help of some Republicans that pander to the "environmental" lobby have created these high oil prices for us with their policies. They don't have a solution to the high prices, because the high prices are desirable to a large percentage of the liberal lobbying groups.
Therefore the Democrats don't really want to solve the problem, they just want to redirect the blame on someone else.

Congresses ban automatically expires yearly!! If they don’t have the votes to renew their yearly ban, as of Sept. 30th, and that includes enough votes to overide a veto, they’re screwed. This is great news. Bush is not quite as stupid as everyone thinks. Almost, but not quite. This gambit may be his first and last great move of his presidency.

This statement assumes several things which probably are not true. The oil industry has probably been aware of this building crisis for a while and may realize we cannot drill our way out of this problem. Alternatives are needed and most of the companies have already started to explore them, including cellulosic ethanol, solar, and biobutanol. In addition, the high oil prices are just making the oil companies richer, and pushing the public to urge their representatives to open up restricted oil land and sea. Incidentally, I don’t think that oil company profits are the chief cause of the run-up in price. For that check out the available information on oil ETFs and the supersized purchasing instruments promoted in January 2007 which are being used by non oil users. Non end users have jumped from 30% to over 70% of the oil commodity market in the past several years.
