In the most detailed examination yet of Senator John McCains eligibility to be president, a law professor at the University of Arizona has concluded that neither Mr. McCains birth in 1936 in the Panama Canal Zone nor the fact that his parents were American citizens is enough to satisfy the constitutional requirement that the president must be a natural-born citizen.
The analysis, by Prof. Gabriel J. Chin, focused on a 1937 law that has been largely overlooked in the debate over Mr. McCains eligibility to be president. The law conferred citizenship on children of American parents born in the Canal Zone after 1904, and it made John McCain a citizen just before his first birthday. But the law came too late, Professor Chin argued, to make Mr. McCain a natural-born citizen.
Its preposterous that a technicality like this can make a difference in an advanced democracy, Professor Chin said. But this is the constitutional text that we have.

My morning paper had it clustered with with some wonderful pictures of the ‘naturally born’ Obama and a happytalk photo of Hillary - and two bashes at McCain included your article.
I am fascinated and offended at the bias we are expected to swallow... but many fall for it don’t they?
That was my first thought. My second thought was, "There goes the Get Drunk and Vote For McCain movement."
I was just starting to get over my grief from Super Tuesday and was starting to get excited about the election again.

Yeah, yeah. And Barry Goldwater was unqualified because he was born in the territory of Arizona.
We will find out in November. I still am harboring delusions that Obama is more popular with the press than he is with the general electorate.
Mitt and Rudy may be the only guys who make McCain look good
by comparison. Mitt is a technocrat, not a conservative.
This doesn’t make him a bad person, nor did it make haim a bad governor, but we need, although we won’t get, someone who knows when to say “I know you have problems, but they are personal problems, and the Constitution says it is not our place to interfere in either yourtriumph or your tragedy!”.

Meanwhile, while there may or may not be legal issues surrounding McCain’s eligibility- he, at least, has provided an actual paper birth certificate and documents regarding the hospital where he was born, etc.
Can one ask only one candidate to provide these items while giving the other a free pass?
Alternately- is the NYT’s getting ready to lower the boom on Obama’s questionable documentation of his birth?
