A retired steelworker who served as a Nazi guard should be deported even though the United States granted him a visa in 1956, a federal appeals court ruled Tuesday.
Anton Geiser's work as a guard meets the type of persecutory conduct banned under the Refugee Relief Act, which was in effect when he entered the U.S., the ruling said.
Geiser, 83, did not cite his Nazi ties on his visa application, but he is not accused of lying about them. Files from the period have been lost and it is not clear what questions he was asked.
His lawyer, Adrian N. Roe, argued to the court this year that guards not deemed war criminals were sometimes allowed in by the State Department. He complained that the Justice Department, in its efforts to expel former Nazis, was revisiting decisions made a half-century ago.
But the 3rd U.S. Circuit Court, which focused on the language of the Refugee Relief Act, said Geiser should have his U.S. citizenship revoked and be deported.

I seriously doubt he volunteered to be a guard . And you just couldn’t tell the Nazis you’d rather not be a guard . The guy is 83 - give him a break .

I agree. The time to convict and deport him was back when he initially came here. Since the government missed that opportunity, and this man has become integrated fully into our society, might as well let him stay.

I'll give him the break I'd give any illegal who lied to enter this country, strip him of his citizenship. Deport him if a nation will take him, most don't want the stench, if not, let the sleaze live his life out here as an illegal alien.

As to Germany, this guy doesn't ring an immediate bell, but in general they're deported to any nation pressing criminal charges, rare, otherwise to wherever they came from, which is usually unclear.

This government can deport an 83-year-old former Nazi guard, but balks at rounding up a couple million Mexicans who came ashore yesterday? Or a hundred thousand towelhead agitators whose sole desire is to wreak havoc on innocent Americans? I’d take 10 ex-Nazis for every muslime, and throw in a ‘65 Chevy full of Mejicanos to boot.
If he is 83 now, he would have been 20 when the war ended. While I have no time for the atrocities that happened in Germany before and during WWII, I have a hard trouble accepting him as a “war criminal” based on his age.

No one is accusing him of being a war criminal, that's up to his home country, wherever that is, who I suspect is disinterested.
The issue is his citizenship and illegal entry.
I'm open to amnesty under some conditions, not for SS members I admit, but what are you suggesting, in terms of time and criminal activity.
