Cesar Laurean, wanted since Jan. 11 for the killing of a pregnant Camp Lejeune Marine, has been captured in Mexico, said Capt. Rick Sutherland of the Onslow County Sheriff's Department.
More details will follow as they develop.
Wow! I hadn’t picked up on the possible email to the sheriff. Cesar’s murder case would be handled by civilian courts since the incident happened off base. I don’t think the UCMJ would have any jurisdiction. The military WOULD have jurisdiction over any rape charges, desertion, or other charges they like to throw in like dereliction, etc.
I noticed the article mentioned the Marine Corps would have to file charges before the first extradition hearing if they wanted to try him......so maybe I’m wrong about their jurisdiction. Anywhoo, this threat could force Cesar to waive extradition quickly if he’s afraid of the UCMJ system. Cesar may have himself in a bind.
The whole story is wacky.
I don’t have the time-line but there was some sort of Company party on the night Maria went missing - that provided an alibi for Christina but not Cesar.
I’m looking at the photos of this 21 yr-old married father of one daughter and he appears not to be a “man” who planned a murder, an alibi or an escape.
One has to wonder what kind of confrontation caused him to savagely beat and murder a pregnant woman he has recently claimed “he loved” and did not rape.
One also has to wonder how his wife remained so cool when she comes home, finds a dead pregnant woman in her house and a blood soaked husband.
If my husband’s pregnant girlfriend is lying on the floor -I’m pretty sure I would snatch up my toddler, run for my life and call the police.
If Cesar killed Maria - Christina sure came up with a plan to clean up, cover up, write a confession, send Cesar packing and claim she “knew nothing”.
If Christina killed Maria - after using him to clean up and help out, she wouldn’t want Cesar hanging around and falling to pieces all over her story line. She sure made sure he was long gone before she “found” “his” note.

In the document she says her husband told her:
Lauterbach showed up at their home on December 15, and told him she was planning to leave the area. “Maria Lauterbach was disoriented, agitated and acting differently.”
Lauterbach demanded money, and Cesar Laurean went with her to the bus station to buy a ticket, which authorities say was never used.
Lauterbach returned to the Laurean home, told him her plan had failed and they began arguing.
Lauterbach “produced a knife and killed herself by slitting her throat.”
“He became scared, took her body to a wooded area adjacent to his residence and buried her.”

What if Maria and Cesar were having an illicit affair? First of all, if caught they would each be prosecuted, for adultery in the military is a crime. What if Cesar was less vested in the relationship and a rebuffed Maria felt she could teach him a lesson by filing a rape charge? In an effort to stem an investigation that could prove ruinous to his career and his marriage, Cesar then turned his attentions back to Maria. Or perhaps he did have strong feelings for her after all.

DA: May Take Months for Marine to Return From Mexico
JACKSONVILLE, N.C. — It could take even longer to return a Marine from Mexican custody to face a murder charge in North Carolina than originally thought, the district attorney who will prosecute the man said Tuesday.
Onslow County District Attorney Dewey Hudson said he learned that it could be three to four months before Cpl. Cesar Laurean returns. Hudson said that time frame assumes the 21-year-old Laurean agrees to be brought back to the United States without a legal fight.
The timetable applies "even if he's begging to come back," Hudson said.
Mexican judge’s recommendation just the beginning
Marine Cpl. Cesar Laurean, accused of murder in Onslow County and arrested in Mexico after a three-month manhunt, could not immediately waive extradition back to the United States even if he wanted to, officials say.
"I have heard the rumors that he will be back here in a day or two, but there is a process that will take a certain period of time," said Dewey Hudson, district attorney for the 4th Prosecutorial District, which includes Onslow County.
Laurean - indicted for the first-degree murder in the bludgeoning death of Lance Cpl. Maria Lauterbach in December and accused of burying her body and that of her unborn child beneath his backyard fire pit - had his first appearance in front of a judge in Mexico over the weekend, said Capt. Rick Sutherland of the Onslow County Sheriff's Department.
The judge recommended extradition, Sutherland said, adding there are steps to be taken and "we do not know what (Laurean) will want to do."
Laurean has representation in Mexico, said Jacksonville lawyer Wally Paramore, who has been appointed as Laurean's attorney by the state's Capital Defender's Office.
He said he hoped to be in contact with Laurean through his representatives there and would then have a better idea of his client's situation.
Laurean was arrested walking to an Internet cafe, where authorities said he had been using a computer to ask for help from his family - including his wife, Christina Laurean, also a Marine, who has been ordered not to discuss the case. She refused to send money to her husband, local investigators said.
The efforts of law enforcement to eliminate Laurean's resources led to his "impoverished state" living in a tiny wooden cabin and having 10 pesos in his pocket when he was captured, authorities said.
Laurean left Onslow County on Jan. 11 after becoming the focus of the investigation into Lauterbach's disappearance, authorities said. An Internet story about Lauterbach's disappearance and an attached investigation report about Lauterbach's rape allegations were viewed on a computer in Laurean's Meadow Trail home about 4 a.m. that day, detectives learned after seizing the computer.
Laurean rode a bus into his native Mexico, according to the FBI.

The seven subpoenas released Tuesday paint a detailed picture of how federal authorities and Onslow County detectives tracked Cpl. Cesar Laurean in Mexico.
The first subpoena, filed Feb. 11, asked Internet service provider Road Runner to provide the physical location of an IP address used Jan. 21. Three days later, they asked Road Runner for the same information for another IP address used Feb. 10.
Over the next several weeks, authorities subpoenaed cell phone records from Verizon and the IP logs for two Yahoo e-mail addresses, including Laurean's wife's address.

Onslow County District Attorney Dewey Hudson has said that evidence recovered from the computer Christina Laurean used allowed detectives to identify the Internet cafes in Mexico where Laurean accessed the Internet. At first, the authorities were always a step behind, he said.
But, it appears they caught up with him around April 1 when authorities asked Embarq to provide the phone numbers of all calls made to a phone number with a Jacksonville area code between 7 p.m. and 7:45 p.m. March 31.

* The phone records from Embarq for the Subway Restaurant at 109½ Western Boulevard on March 31 from 7 to 7:45 p.m. Christina Laurean's brother-in-law works there, Subway employees confirmed Monday.
* The subscriber information from Verizon Wireless for a phone from the Denver metropolitan area.
* Subscriber information and IP logs from Roadrunner of two e-mail accounts from Yahoo and two IP addresses.
* Information from Marine Federal Credit Union on "all bank accounts of Cesar Laurean" including "receipts, checks, POS transactions, and account changes and accesses" from Jan. 14 to Feb. 15.
