Not a problem in some communities, where they’ve already banned outdoor grilling due to the carcinogens produced in the smoke (or maybe their contribution to smog or something, I dunno). I kid you not.

I fail to see how this will be enforced. While there might be probable cause from smelling smoke, won’t the cops have to get a warrant from a judge to enter and search your home?

I wonder how the law is written. Does it say persons cannot smoke in their apartments? Or does it say smoking materials cannot be used? If it's the former, can someone simply leave a burning butt in an ashtray on the balcony???

If you hated cigarette smoke, then why did you live in a condo and not single unit? I thank God that I own my own home and don’t have to worry about offending anyone.

Oh, BTW? I lived down the street from some Asian people who fermented squid in their backyard. You could smell that two blocks away...

What, you didn't demand that they be evicted from their home because you were offended and have a Constitutional right to a stinky-free environment?..:-)

Anyway, I don't put much stock in these anecdotes about the neighbor's cigarette smoke from downstairs being detectable in an upstairs apartment. I spent a lot of time in really old tenement buildings in my lifetime and not once, never, have I observed this strange phenomenon.

I wonder how it's supposedly happening in newer, more insulated buildings.

You’re right. I lived in a low-income apt. once and the only smoke problem we had was when the hippie downstairs caught her footstool on fire after a big bong hit.

I woke up to my baby coughing and - not knowing what it was - called the fire dept. right away. That’s a far cry from cigarette smoke, though. This was real smoke, thick and black!

If a person doesn’t want the possibility of being surrounded by something they don’t like, then why do they insist on putting themselves into that situation? Why don’t they move into a single-unit or to non-smoking complex? Problem solved, simple as that, no need for any type of intervention, and peace of mind and happiness. :-) Doesn’t take much thought and personal responsibility to come up with this solution.

BTW, we did move. We didn’t complain to the homeowners’ association. We didn’t file a lawsuit. We moved.

As I mentioned above, this issue doesn’t affect me any more. I’m just having fun because so many people get so up in arms about it.
