It's Official -- Belmont (California) Bans Smoking In Some Homes (Big Brother/Nanny State alert)

BELMONT, Calif. -- The Belmont City Council on Tuesday night adopted a landmark ordinance regulating secondhand smoke in the city.

The ordinance passed on a 3-2 vote and will go into effect in 30 days, according to City Manager Jack Crist.

Thought to be the first of its kind in California, the ordinance declares secondhand smoke a public nuisance and extends the city's current smoking ban to include multi-unit, multi-story residences.

Though Belmont and some other California cities already restrict smoking in multi-unit common areas, Belmont is the first city to extend secondhand smoke regulation to the inside of individual apartment units.

This is (or at least should be) blatantly unconstitutional if people own these places. Of course, i wouldn’t expect it to be overturned in a California court or the federal appeals court serving that District. What a crock. Next thing, you will have to submit to blood tests for nicotine and high deposits of fatty foods.

I’m so sick of this dancing around.
Make smoking illegal and be done with it!

I realize they want to keep the illusion of being concerned about people’s health. But the real motivation is they don’t like smoking.

I hate cigarette smoke. I lived in a condo, and the woman below us smoked. Every time she did, our home smelled like an ash tray.

I know it’s extremely unRepublican and unLibertarian to say, but I’d welcome such a law here where I live.

How about buying in a complex in which the rules preclude smoking, if you don’t want to smell smoke from a neighbor’s unit. Please leave the government out of it.

Leave them alone; it’s for the children.

If you don’t let people smoke, there won’t be any funding for health care.

People won’t buy them, if they can’t smoke them, and then the SCHIP funding loses it’s tobacco tax income, and all those poor little kids, like Graeme & Gemma (http://www.freerepublic.com/focus/f-news/1908585/posts) wouldn’t get the care they need.

I fail to see how this will be enforced. While there might be probable cause from smelling smoke, won’t the cops have to get a warrant from a judge to enter and search your home?

Thr real motivation for the smoker-hater movement is the money. Think SCHIP, MSA, etc. The states have been using tobacco tax money to make an attempt to balance budgets ever since the extortion racket known as the MSA has come into affect.

What you posted is correct, but it applies only to the small legion of “true believers”.

It brings in money. Also, it’s none the government’s business what we do especially in our own homes. I think it’s time to start making the government accountable and the court system too.

Just hope you don’t move to my neighborhood.

I’m amazed at the people who think odors from another’s home make theirs unlivable. I can only assume they’ve never emptied a kitty litter pan, changed a dirty diaper, cleaned a bird cage, cleaned the oven with amonia, left a toilet unflushed when the water went off, yada, yade yada.

The reason I hope you don’t move to my neighborhood is I have a horse stable, a cow lot, and two hen houses. My place would need to be banned entirly due to it’s HIDEOUS, DEADLY, and TOXIC odors.
