Penalty Mitigation in the Immigration Reform Bill [White House Spokesman Responds: Post #53]
Free Republic ^ | 6-13-2007 | philman_36

Posted on 06/13/2007 6:57:12 AM PDT by philman_36

This morning on Fox and Friends there was made mention that much stricter fines are in the immigration reform bill. While this is true many folks may not know about a few words that follow the language about the tougher fines. Those words make a travesty of any "fines" as they can be waved and the employer could walk away owing nothing in penalties.

Here are the words I've got a problem with...

(D) The Secretary is authorized to reduce or mitigate penalties imposed upon employers, based upon factors including, but not limited to, the employer's hiring volume, compliance history, good-faith implementation of a compliance program, participation in temporary worker program, and voluntary disclosure of violations of this subsection to the Secretary.

So while we're being told that "the penalties are tougher" we aren't being told that under some circumstances employers can face reduced or even no fine whatsoever.
At this point of time in our history America can't afford our officials not being completely truthful to us and not stating that the possibility exists for employers to potentially be let off the hook completely is simply unacceptable.

You mention that not all employers knowingly hire illegal immigrants. Yet after reading the following- I wonder how often that’s truly the case:

Jobs Americans Won’t Do, Part DCCLXIX [Mark Krikorian]

The indefatigable Norm Matloff, a computer science professor at UC Davis, pointed me to this video of an immigration lawyer explaining to clients how to pretend to look for American workers in such a way as to make sure they don’t actually find any (it’s at about 7:55). The law firm may take the video down once it gets some publicity, so here’s the nut graf:

And our goal is clearly not to find a qualified and interested U.S. worker. And you know in a sense that sounds funny, but it’s what we’re trying to do here. We are complying with the law fully, but ah, our objective is to get this person a green card, and get through the labor certification process. So certainly we are not going to try to find a place [at which to advertise the job] where the applicants are the most numerous. We’re going to try to find a place where we can comply with the law, and hoping, and likely, not to find qualified and interested worker applicants.

This is why "the vampire bill" needs to have a stake driven through it's chest.
Thought you might like this line...Immigration bill is a fraud Mark Steyn
I don't know whether this sham of a bill is dead or just resting ''in the shadows'' like a fine upstanding member of the Vampiric-American community.

Good find Beaversmom! I have the feeling the Whitehouse already knows where I stand on this POS bill! Nthompson: I meant what I said in various emails to senatewhores and RNC people. You have lost my support. Push this crap thru and I think the ‘pub party is dead. Especially if you succeed in getting Ghouliani as nominee in 2008.

Hillary has as much chance of winning the Presidency as I do.

She will not be the nominee.

If the applicant is found eligible for the Z status, then the worker must pay a $1,000 fine for head of household and $500 per dependent; up to $1,500 in processing fees per applicant, including heads of household and dependents; and a $500 state impact assistance fee.>,cite>

You just don't get it, do you? Tell me what happens the the ones who legally applied for legal status for themselves and their dependents? The ones who are separated from their families awaiting the processing of the petition? The issue is being avoided, shifted, being told they they will have priority but we all know it's a bunch of lies. You will hire more agents to handle this, create an even more monstrous Immigration Dept and the legals will be treated as the illegals. So much for fairness. You seem to forget about what makes you conservative and that being the disbelief that the government will keep its word and follow the rule. You tell me where are the agents and where;s the border wall approved last year? You produce what you promised already and then, maybe, we might believe you. Until then all you have managed to do is estrange most Republicans. Next elections will be won by Democrats and you will be the single reason why. We will NOT vote for you. I never thought myself being pushed in the situation of blatantly not agreeing with the President but you made it quite easy. I no longer call myself a Republican, I am a Reagan Conservative who will vote with the Reagan Conservative candidate (may he/she be Democrat and Republican). So thanks for hijacking my party, you arrogant and clueless Liberals.

You are so incredibly naive it is unbelievable.

“All illegal aliens will not immediately gain legal status if this bill passes, and no one is immediately given Z status.”

As soon as the bill passes, all illegals will have had their status completely muddied - are they in process? are they applying in the future? Are they never going to apply?

Because you haven’t established the rule of law over the last 7 years, enforcement will be laughed at. How are you going to keep track of who has a zvisa when you can’t even sort out who is illegal now? So what you end up with is De Facto legalization of everyone. If you don’t understand this, then you don’t live in a southwestern city like I do.

“The only people granted Z status are those who come out of the shadows and apply, which involves a probationary period that is gained through a preliminary background check.”

Why in heaven and hell would an illegal be Stupid enough to apply for a zvisa and pay taxes hen they can continue to work off the books, and in the worst case apply later down the road? Or, get a counterfeit one? It isn’t like you are gonna build a fence to keep them out in the very unlikely event that they get deported!

“They will stay in probationary status while a Z visa application is pending, and it may be revoked at any time if the applicant is found ineligible for the Z visa, fails to maintain a clean record, or fails the background check required for obtaining a Z visa.”

Oh yeah, like you do a damn thing about the fully illegals theives and cutthroats that are here now. You guys have zero, zip, nada credibility.

“If the applicant is found eligible for the Z status, then the worker must pay a $1,000 fine for head of household and $500 per dependent; up to $1,500 in processing fees per applicant, including heads of household and dependents; and a $500 state impact assistance fee.”

None of the illegals I know (and I know a lot) ever pay fines. What makes you think they will start now?

Tell the guy in the White House he is a lunatic if he believes any of this. He needs to get a real life and come live near a barrio that is destroying the surrounding community.

Then kindly quit tossing the 'if you don't vote Republican you're voting for Hillary' canard around.

Thanks.

Nick

I have supported Bush through thick and thin. Thin just became insupportable.

His logic in this matter is utterly opaque to me. I have read the bill. There will be a flood of illegals in the years to come undermining America, if this bill becomes law.

While I doubt you have the stature to relay much upstream, please try and tell George & Laura: This tears it for me and countless other conservatives. I will resist every way imaginable the imposition of this on our republic.

And no, Jorge, I haven’t a racist bone in my body. Angry is not the word. ENRAGED.
