:The last charge, withholding evidence, took center stage in the case of former death row inmate Alan Gell, a Bertie County man wrongly convicted of murder in a slaying that happened while he was in jail on unrelated vehicle theft charges.
In that case, two prosecutors from the Attorney General's Office, David Hoke and Debra Graves, withheld statements given by people who saw the victim alive after Gell had been jailed. The prosecutors also withheld a tape recording of the state's star witness saying she had to "make up a story" for the police."
The bar delivered a written reprimand to Hoke and Graves after a two-day hearing on misconduct charges... Dudley Humphrey, then-president of the bar, was met with derisive laughter when he asserted that Gell was not the victim in the prosecutorial misconduct case. "The system was the victim," Humphrey said."
""The difference is that this case really has gotten so much publicity that the elder statesmen of the bar are embarrassed and they're going to demand something different," said Bill Massengale, a Chapel Hill lawyer and former prosecutor. "Mike Nifong's carrying the baggage for the Gell case and the baggage of the Honeycutt and Brewer case.""

The Durham police, the Duke Administration and at least 88 members of faculty, much of North Carolina media, the poverty pimp and brood mare brigades and then we have Nifong — representing the State of North Carolina....
Rational folks have painted much of that part of the country as bumpkins - all too ready to hang some innocent white boys on the lying words of a nappy headed professional skank with a record that Nifong should have been aware of.....
Someone has to hang....
Nifong is closest and most reachable....
But CLEARLY not the only one deserving of being hanged.

The hearing committee wanted to ask the investigator something about what he said in the Grand Jury. The investigator said that he was not allowed to talk about it by the law. The three judge panel asked for time to have the law researched. I think that the answer came back that the disallowed testimony was correct under the law. I guess that means the DA can lie or leave out evidence in the grand jury and never be accountable as there is no written transcript (IIRC) and no testimony allowed later. What a system. It is scary.
One of the reasons that this case took on national attention is because it showed that anyone can be wrongly accused. The Soviet Union rears its ugly head.
Guess he should have been careful what he wished for. I hope Fong gets everything he deserves. I see that stupid smirk has been wiped off his face. Wonder how that twitch is now?
