It's Not Amnesty, It's a Financial Plan

For the past 10 days, politicians—including the president—have harangued us with assurances that the shamnesty bill is not amnesty. "Amnesty is a pardon with no penalty," they say. Because the bill would impose a monetary penalty, they insist it is not amnesty.

A careful reading of the bill shows that the dollar cost of the fine is far below the value of the benefits that illegals would enjoy after paying it. So one could say that it's not amnesty—it's an investment, and a very good one at that.

Let's assume that the bill has passed in its current form. How does it affect J.M., an illegal alien farm worker who wants to get right with the law?

First, he'll pay an application fee for a Z visa. And a fine of $100 (other aliens will pay $1000, but farm workers get a 90% discount.) He's confused by the enormous complexity of the new law, but no problema. To guide him through the process and deal with any trouble along the way, he has a lawyer from Legal Services Corporation, compliments of the U.S. taxpayer. Contrary to the spin from the White House (see first Myths pronouncement), J.M. becomes eligible for welfare benefits in five years. Unlike most American citizens, for whom employment is at will, J.M.'s employer can only fire him for "just cause." If he someday decides that he was fired without just cause, taxpayers will pay the cost of an arbitrator.

J.M.'s oldest children are now young adults, but were minors when he brought them into the country. Because of this, they are immediately eligible for various forms of higher education assistance. They can get in-state tuition at their state university. (Children of American citizens outside the state cannot.) But they do have to be patient before receiving the biggest prize of all. Three years after the law goes into effect, they will be entitled to green cards (permanent residency) as long as they have not done anything to make them ineligible (such as discriminate against someone based on race or sex), have earned a high school diploma or GED, and have either two years of college or military service.

J.M.'s youngest children were born in the U.S., making them American citizens. If one of their parents should die while they are still minors, they will be able to claim Social Security benefits on the parent's earnings during the years of illegal employment.

This is quite a return on an investment of 100 bucks plus application fee. It could almost put Hillary's cattle futures windfall to shame.

Technical question: Is there any time limit on applying for a Z-visa? Can 5 million more sneak in in the next couple of years, forge a bunch of documents, and then file for Z-visa years later?

Even that argument is disingenuous and incorrect.

The monetary penalty ONLY applies when the illegal applies for a Z-VISA.

Previous to or instead of that, the illegal gains status the moment the bill is signed. The bill prohibits deporting any illegal who does not have a criminal record. [Crossing the border is excluded from being identified as a crime.] And that is de facto amnesty.

I have to laugh with the pro-illegal/open-borders people try to defend their position. The only way they can is by mixing and muddling the issue--by slipping in the term immigrants and using that as the basis for their argument. They think we don't notice, because OUR problem is not with legal immigrants; it is with illegal immigrants. They can't defend their position regarding illegal immigrants, so they drop the illegal part and use the inclusive immigrants.

A con artist would call it the ole shellgame.

The proponents talk about the small percentage who are deported, while expecting us to ignore the massive number hiding behind the curtain.

Write your Senators. You could send the following to Senators Cornyn and Hutchison if you are from Texas:

“I was very sorry to see that you voted against Senator David Vitter’s amnesty-stripping amendment. It appears that you will do whatever the Texas Association of Business (with its “We All Need Workers” campaign) desires. I cannot match the campaign contributions from the members of the Association; but I can vote against any one who continues to support Ted Kennedy’s Amnesty Bill (even if the support comes only from the way you vote on proposed amendments and not in the final vote), and I will.”

One of the last and transparently desperate tactic of an advocate with nothing persuasive to say is resort to a static definition of a term that has a normative and evolutionary meaning (I’m aware the term evolutionary may be anathema to many on FR). Pulling out a Webster’s to define away the reality of such a term indicates the vacuity of that defensive response.

In theory, only those who were here before January 1, 2007 are eligible (as well as certain of their relatives).

In reality, millions more can and will sneak in and claim such visas because the documentation required to prove one was here before 1/1/07 is a complete joke. It can be nothing more than an affidavit from a non-relative attesting to the individual's presence here before the cut-off date. Unbelievable.

There is an application period for farm workers. They have to apply within eight years.

I think the reason for inconsistency among sections is that the bill is really a bunch of separate bills hastily strung together.

What I really want to know is how are the Feds going to prevent citizens from creating dual identities? If a US citizen doesn't have a fingerprint anywhere on file that can be matched to a Z visa, how will they be stopped from creating a brand new ID?

Now let's take it one step further and assume you're caught. What's to prevent anyone from either denouncing their citizenship and/or claiming that they're not really a citizen since under some 14th amendment claim that their parents weren't under US jurisdiction.

These might appear to be far-fetched scenarios, but I can practically guarantee that if the financial incentives become high enough in favor of illegals vs citizens, we'll see more & more of these stories.

True... Something must be done about the multi millions of aborted PEOPLE(babies) in the United States.. The answer seems to be IMPORT THEIR REPLACEMENTS FROM MEXICO.. for the economys sake..

The plan has always been to level the playing field. In the minds of the globalists, Americans have too much, and need to be forced to share what they have worked so hard for, nurtured, and believed in.

Keeps the world in line, bring America down to 3rd world status, and we can all share the crumbs the elitists toss our way. Hell of a deal, isn’t it?

If this bill passes (Damn) then it should have a provision that limits the time for applying for a Z. I think 6 months from the time of enactment should be enough! If you miss the 6 month dead line you remain an illegal for the rest of your life! Simple. This is very lenient compared to a 24 hr. background check!

So, since I was born in Germany (I am legal and a US Citizen) I might be able to make a Z Visa claim...so I can claim benefits like an illegal...
